1V~ P30. 9736 ORDER ACCEPTING OFFER OF L. R. FRENCH, JR., TO DONATE RI?HT-OF-WAY FOR R. M. ROAD 187 On this the 8th day of June, 1964 came on to be heard and considered by the Court the offer of L. R. French, Jr „ to donate 21,952 acres of land for Right-of-td ay for R. M. Road 187 in Kerr County, together with four channel easements totaling 0.1+45 acres; and it appearing to the Court that it would be in the best interest of Kerr County to accept this offer on the terms proposed, it is ordered on motion by Commissioner Stone, seconded by Commissioner Witt and unanimously approved by the Court that Kerr County accept the offer of L. R. French, Jr,, to donate 21,9j2 acres of land out of Surveys 16, 1638 and 1641 in Kerr County, together with the aforementioned 4 channel easements and, that upon receipt of the executed right-of-way instruments, Kerr County, for and in consideration of this donation, will build a new fence along all points on the new right-of-way lino where there is no presently existing fence, said fence to be of new materials and to conform to the following specifications and conditions: 1, Heart cedar posts with 5 inch or better tops will be set 30 feet apart with 3 heart cedar stays between and concreted all the way as follows: 10 inches in solid rock, Z feet in dirt ~-- and corner posts 30 inches deep, 2. All metal products to be of domestic manufacture and fence to consist of 939-12-122 net wire with 1 smooth cable wire above and 1 below. 3, Kerr County will furnish 4 gates to Mr. French's specifications using "Can't Sag" gates where requested, 4, Kerr County will erect an 8 foot wire Fence from the north line of the Adair. Wilson, Jr., fence to the proximity of the first gate to the north of said fence line to protect the pen area around the relocated water trough. 5, Fencing when completed to be subject to acceptance by L, R, French, Jr., or his duly a~.athorized representative, with Kerr County withholding its final acceptance and payment for the said fencing pending receipt of a written release from Mr, French. It is further ordered that, as further consideration, Kerr County will do the following: 1. In co-operation with the Texas Highway Department, Kerr County will provide, at no cost to Mr. French, a combination drainage structure and shock pass to be located near station 45 ~-„ of the centerline of the new roadway, said structure to consist of an 8 foot x 8 foot concrete box approximately 104 feet in length, which structure shall be utilized for connecting pastures on each side of the road, 2. Kerr County will relocated the existing water trough on the north side of the present county road to a point near the present Adam Wilson, Jr, fence and connect the same with the present tank with a 12 inch galvanized pipe, properly cased under the roadway in a large pipe and will construct a wire livestock pen around the water trough as per previous verbal agree- ment, 3, Where necessary, Kerr County will erect temporary fencing along the present unfenced portions of the existing county roadway to keep the livestock of Mr. French within his pastures during the construction of the new roadway. 4, Following completion of the new roadway, such portions of the existing county road known as the "Station C Road" as lie wihtout the boundaries of the new right-of-way for R, i4, Road "~ 187 will be declared closed and abandoned and shall revert to the record owners of title thereof, o-o-o-o-o-o-o-c-o-o NC. 9737 READIiVG AND APPROVAL OF MINUTES On this the 8th day of June 1964, upon motion made by Commissioner Bartel, seconded by
