On this the 10th day of August, 1964 cage on to be heard and considered by the Court the
locking oŁ a date across the Ashton Road, a public roadway in Precinct No, 4 of Kerr County,
and it appearing to the Court that the said Ashton Road has been continuously :maintained and
kept in repair as a public roadway by various County Commissioners of Irecinct Pto, 4 of Kerr
County for many years and that such fact is further verified by an affidavit executed by former
CGUnty Co rr,issionar Lee Goff as is of record in Vol. 104, Page 5~1, Kerr County Daed Records,
which affidavit is hereby incorporated by reference into the terns of this order and made a.
,r art hereof for all purposes, and it appearing to the Court that the erection of a locked gate
across such rublic roadway is contrary to and in violation of the laws of this State and
further contravenes the duty of 'the Commissioners Court to keep all established public roadway*s
unobstructed for use by the rublic, it is therefore ordered. on motion by Commissioner Stone,
seconded by Com.,~issicner Bartel and unanimously arproved. by the Court that George E, Ross,
a. resident of Kerr County, Texas, be ordered to remove all locks and connecting chains from
such gates as he may have erected or may hereafter orect across the said Ashton Road, but that
he be permitted to retain all necessar;,~ and properly constructed gates across said roadway
but to leave them so latched that the public may readily open, Hass thr~-ugh an'? reclose the
same and it is further ordered that the Cleri: of this Court shall prepare a certified copy of
this order snd attach thereto a certified copy of that certain affidavit recorded in Vol. 104,
Fage 581, Kerr County Deed Records, an~_? shall causo the Sheriff of Kerr Gounty to servo tI-_e
same on the said George E, Ross, ar,d make proper return thereof in the manner prescribed by the
rules of Civil ^rocsedure,
