Parmelee. As part corn ideration, it is agreed by Commissioners' Court of Kerr County, Texas, in connec- tion with the property of said Clyde D, Parmelee and wife, Barbara H, Parmelee, on State High- way 27 on the Kerrville-Ingram Road, being a strip of land 30 feet in width taken off of the South side of the Clyde D, Parmelee property, said strip lying along and adjacent to the present North right-of-way line of State Highway No. 27, with its North side being 90 feet from and parallel to the center line of said Highway, and extending from the East line of the Clyde D, Parmelee property at Station 1130+01 to the West line of said property at Station 1137+32. Said strip of land containing an area of 0,544 acres of land, more or less, to move present fences situated upon said property and rebuild the same upon new right-of-way line without cost to said Clyde D, Parmelee and wife, Barbara H. Parmelee and will replace the same in at least as good condition or better than its present state; and will retain all trees except those that are necessary for the safety of traffic on said highway; and will replace native ^,,. rock entrance to premises with retaining wall in as good condition as present one located at said entrance. Parmelee or Clyde D, Parmelee, now a former owner of the lands concerned, it is ordered on motion by Commissioner Stone, seconded by Commissioner Schwethelm and unanimously approved by the Court that Kerr County offer the said Barbara H. Parmelee in her individual capacity and as successor in title to Clyde D, Parmelee the sum of $150.00 cash and in addition declare closed and abandoned an unopened roadway in the Bivouac Estates Subdivision which roadway is described in Order No. 9817 entered this date by the Court, which total consideration shall be in full and final settlement of any heretofore outstanding claims arising against Kerr County in favor of Barbara H. Parmelee and Clyde D. Parmelee and Łor their successors in title as a consequence of the agreement above set forth, provided that the said Barbara H. Parmelee shall execute a full release granting Kerr County relief forever from any additional claims arising out of the aforesaid agreement, and it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the General Road and Bridge Fund in the amount of $150.00 payable to Barbara H.
