Concerning property of Col. Clyde D. Parmelee and wife, Barbara H. Parmelee.
As part corn ideration, it is agreed by Commissioners' Court of Kerr County, Texas, in connec-
tion with the property of said Clyde D. Parmelee and wife, Barbara H. Parmelee, on State High-
way 27 on the Kerrville-Ingram Road, being a strip of land 30 feet in width taken off of the
South side of the Clyde D. Parmelee property, said strip lying along and adjacent to the present
North right-of-way line of State Highway No. 27, with its North side being 90 feet from and
parallel to the center line of said Highway, and extending from the East line of the Clyde D,
Parmelee property at Station 1130+01 to the West line of said property at Station 1137+32,
Said strip of land containing an area of 0.544 acres of land, more or less, to move present
fences situated upon said property and rebuild the same upon new right-of-way line without
cost to said Clyde D. Parmelee and wife, Barbara H. Parmelee and will replace the same in at
least as good condition or better than its present state; and will retain all trees except
those that are necessary for the safety of traffic on said highway; and will replace native
~. rock entrance to premises with retaining wall in as good condition as present one located at
said entrance.
This agreement shall be binding upon Kerr Gounty and the said Clyde D. Parmelee and wife,
Barbara H, Parmelee,. their heirs and assigns forever.

and it appearing to the Court that the rock entrance and retaining wall referred to have not
been replaced by Kerr County and that no settlement as to this portion of the consideration has
heretofore been made with either Barbara H. Parmelee or Clyde D, Parmelee, now a former owner
of the lands concerned, it is ordered on motion by Commissioner Stone, seconded by Commissioner
Schwethelm and unanimously approved by the Court that Kerr County offer the said Barbara H.
Parmelee in her individual capacity and as successor in title to Clyde D, Parmelee the sum of
$150.00 cash and in addition declare closed and abandoned an unopened roadway in the Bivouac
Estates Subdivision which roadway is described in Order No. 9817 entered this date by the Court,
which total consideration shall be in full and final settlement of any heretofore outstanding
claims arising against Kerr County in favor of Barbara H. Parmelee and Clyde D, Parmelee and
for their successors in title as a consequence of the agreement above set forth, provided that
the said Barbara H. Parmelee shall execute a full release granting Kerr County relief forever
from any additional claims arising out of the aforesaid agreement, and it is further ordered
that the Clerk and the Treasurer be authorized to draw a voucher on the General Road and Bridge
Fund in the amount of $150.00 payable to Barbara H. Parmelee, doing so upon receipt of a duly
executed release of Kerr County f rom further liability arising from the aforesaid agreement
dated August 1, 1951, and that said release, when delivered, shall be recorded in the minutes
.- of this Court.

On this the 25th day of September 1964, upon motion made by Commissioner Bartel, seconded

by Commissioner Stone, the Court unanimously approved the claim to Salvation Army Home for
incidental expenses for Mary Sue Weathersby, Kerr County juvenile, receiving care at the Home,
and the Clerk and Treasurer be authorized to draw a voucher on the General Fund in the amount
of $25.00 made payable to the Salvation Army Home.

':WHEREAS, on the 1st day of August, 1951, Clyde D. Parmelee and Barbara H. Parmelee did
enter into an agreement with John R. Leavell and Henry Eckstein, County Judge and Commissioner
of Precinct One respectively of Kerr County, Texas, whereby the said Clyde D, Parmelee and
Barbara H, Parmelee agree to convey certain lands for right-of-way for State Highway 27 in
Kerr County, wherefor they were to receive as compensation certain consideration as is set
forth in said agreement as is now recorded as a portion of Order No. 9818 of the Commissioners
Court of Kerr County, Texas, in Vol. P;, Page 194 of the N,inutes of the said Court; and,
WHEREAS, certain acts which were to be performed by Kerr County, Texas, as a portion of the
consideration set forth in said agreement have not been perforred and cannot now feasibly he
performed; aad,
WHEREAS, by virtue of the aforesaid Order 9818 of the Commissioners Gourt of Kerr County, an
offer of settlement of all unsatisfied claims against Kerr County is set forth and has been

THEREFORE, Know All Men by 'T'hese Presents, that i, 3arbara H. Farmelee, a feme sole,
acting in the capacities herein set forth, for and in consideration of the sum of $150.00 ca s:,
to me in hand paid, b.~ Kerr County, Texas, receipt of. which is hereby acknowledged and for the
further consideration of the action of the Commissioners Court of Kerr County, Texas in declar-
ing closed and abandoned forever an unopened roadway in the Bivouac Estates Addition of Kerr
County, Texas, which action is evidenced by Grder ido. 9817 of the said Court as recorded in
Vol. M, Page 194 of the Court minutes, do hereby release forever the aforesaid Kerr County,
Texas, its legal representatives and successors from any further liability whatsoever arising
from the terms of the aforesaid agreement dated August 1, 1951, and this agreement of rlease
shall be binding on myself, my heirs and assigns forever.
