.WHEREAS, on the 1st day of August, 1951, Clyde D. Parmelee and Barbara H. Parmelee did
enter into an agreement with John R. Leavell and Henry Eckstein, County Judge and Commissioner
of Precinct One respectively of Kerr County, Texas, whereby the said Clyde D. Parmelee and
Barbara H. Parmelee agree to convey certain lands for right-of-way for State Highway 27 in
Kerr County, wherefor they were to receive as compensation certain consideration as is set
forth in said agreement as is now recorded as a portion of Order No. 9818 of the Commissioners
Court of Kerr County, Texas, in Vol. l4, Page 194 of the N.inutes of the said Court; and,
WHEREAS, certain acts which were to be performed by Kerr County, Texas, as a portion of the
consideration set forth in said agreement have not been performed and cannot now feasibly be
performed; and,
GJHEREAS, by virtue of the aforesaid Order 9818 of the Commissioners Court of Kerr County, an
offer of settlement of all unsatisfied claims aPainst Kerr County is set forth and has been
found to be acceptable by the ~~nder~;vned Barbara H. Parmelee in her individual capacity and

as successor in title to Clyde D. Parmelee as to the lands concerned,

acting in the capacities herein set forth, for and in consideration of the sum of $150.00 cas:<

further consideration of the action of the Commissioners Court of Kerr County, Texas in ceclar-
ing closed and abandoned forever an unopened roadway in the Bivouac Estates Addition of Kerr
County, Texas, which action is evidenced by Grder ido. 9817 of the said Court as recorded in
Vol, if, Page 194 of the Court minutes, do hereby release forever the aforesaid Kerr County,
Texas, its legal representatives and successors from any further liability whatsoever arising
from the terms of the aforesaid agreement dated August 1, 1951, and this agreement of rlease

On this the 2nd day of October, 196L; came on to be heard and considered by the Court
the matter of settlement for fencing constructed by Gabriel Mata in Kerr and Bandera Counties
along R.M. Road 187, said forcing having been constructed pursuant to bids accepted by the
Court as per Order No. 9768 heretofore entered on the 17th day of July, 1964, and it appearing
to the Court the said fencing has heretofore been inspected by the Commissioner of Frecinct
4 and the County Jude and has been found to be constructed according to specifications and
that the said fencing has been found acceptable by Adam Wilson, Jr, and by Pat Bierschwale
acting for and on behalf of L. R, French, Jr, as is evidenced by their duly executed written
releases, which.releases are herewith incorporated as an appendix to this order, it is ordered
on motion by Commissioner Stone, seconded by Commissioner Bartel and unanimously a; proved by
the Court that Kerr County accept the 32,870 feet of fencing constructed by Gabriel Nata and
that a final settlement be made of the balance clue him as set forth below, with the Clerk and
the Treasurer being authorized to draw a voucher on the R,M. lE7 R-O-W Fund in the amount of

offer of Adam Wilson, Jr., to donate certain lands in Kerr County, Texas, for right-of-way for
Ranch-to-i:arket Road 187, which offer was subsequently extended to include certain lands in
Bandera County, Texas; and
'rJHEREAS, as a 1ortion of the consideration for the said donations, Kerr County did agree
to construct certain fencing along the right-of-vray line of the donated lands in Kerr and
Bandera Counties, said fencing to be constructed as to certain specifications; and
?dHEREAS, as a condition precedent to the final payment of Gabriel Mata who has heretofore
contracted with Kerr County to construct 24,041 feet of fencing, more or less, for Kerr County
