ROAD lE7 A';J iiAKING FINAL FAYi~i:?;N'T' Tu GABftIEL ^4ATA, CONTRACTOR On this the 2nd day of October, 1961? came on to be heard and considered by the Court the matter of settlement for fencing constructed by Gabriel Mata in Kerr and Bandera Counties along R.is, Road 187, said fencing having been constructed pursuant to bits accepted by the Court as per Order No. 9768 heretofore entered on the 17th day of July, 1964, and it appearing to the Court the said fencing has heretofore been inspected by t!-ie Commissioner of Precinct 4 and the County Judge and has been found to be constructed according to specifications and that the said fencing has been found acceptable by Adam Wilson, Jr, and by Fat Bisrschwale acting for and on behalf of L. R, French, Jr, as is evidenced by thoir duly executed written releases, which. releases are herewith incorporated as an appendix to this order, it is ordered on motion by Commissioner Stone, seconded by Commissioner Bartel and unanimously a?:proved by the Court that Kerr County accept the 3,870 feet of fencing constructed by Gabriel Mata and that a final settlement be made of the balance due him as set forth below, with the Clerk and the Treasurer being authorized to draw a voucher on tho R.M, ld7 R-O-i^; Fund in the amount of X1,115,66 as full and final payment of the balance due: Sec, I - One mile and 3,529 feet C ~'~585.00 per mi. STATE OF TEXAS 9 CGUNTY OF KERR G i^:`vEREAS, on the 11th day of May, 1964, the Comumissioners Court of Kerr County, Texas, did by virtue of its Order No. 9718 as is recorded in the minutes of the said Court, accept the offer of Adam Wilson, Jr „ to donate certain lands in Kerr County, Texas, for right-cf-way for Ranch-to-?^.arket Road 1F7, which offer was subsequently extended to include certain lands in Bandera County, Texas; and 7dHEREAS, as a tort;ion of the consideration for the said donations, Kerr County did agree ..- to c^nstruct certain fencing along the right-of-way line of the donated lands in Kerr and Bandera Counties, said fencing to be constructed as to certain specifications; and ''HREAS, as a condition Precedent to the final payment of Gabriel Mata who has heretofore contracted with Kerr County to construct 24,041 feet of fencing, more or less, for Kerr County ~~~ along portions of the right-of-way concerned, it has been agreed by all parties that the fencing so constructed shall be accepted by the said Adam 'rJilson, Jr.; and uJHEREAS, the said Gabriel Mata, an independent contractor, has completed the construction of the said 24,041 feet of fence as delineated and described in Section II of the detail specifications for fencing location for R.M.
