O-G-O-G-G-O-O-O-G-O N0. 9825 GHD~R EXFRCTSING OPTION TC PURCHASE Tb?0 CATERPILLAR N0, 112 t40TOR GRADERS LEASED UNDER COPiTRACTS DATED JAATUARY 26, 1962 On this the 12th day of October, 1961}., came on to be heard and considered by the Court two Lease Purchase Contracts executed by Y.err County and the 'r, K, Holt Machinery Company on January 26, 1962 for two Caterpillar Pao, 112 Motor Graders and it appearing to the Court that payments on the said two contracts are due on January 26, 1965. 1966 and 1967 but treat sufficient funds not otherwise required are now on deposit in the County Depository of Kerr County and that a saving of interest payments on the total unpaid balances of these contracts could be effected by exercising the option to purchase said motor graders under the terms set forth in said contracts, it is ordered on motion by Commissioner Schwethelm, seconded by Commissioner Stone and unanimously approved by the Court that Kerr County exercise the afore- said options as set forth in the two aforementioned contracts and declare its intention to purchase the said two Motor Graders as of Gctober 14, 1964, by making payment of the total balances due on each original contract, plus interest at 4zjo per annum on said balances from January 26, 1964 to October 14, 1964; and it is further ordered that the Clerk and the Treasur- er be authorized to draw the following two vouchers cn the Road and Bridge Fund of Kerr County Davable to the Chas, Schreiner Bank, assignee T~~, ri. Ross to unlock a gate which he had placed across a roadway in Precinct 4 of Kerr County which roadway was referred to in said order as the Ashton Road and further referred to as being a public roadway, and it appearing to the Court, after further examination of the law and facts applicable to the history of this roadway, that the Court acted erroneously in consider- ing and entering its Order No, 9785 due to the lack of public usuage of the roadway concerned either presently or in the past history of its existence, it is ordered on motion by Commis- signer Stone, seccnded by Commissioner Bartel and unanimously approved by the Court that the aforesaid Commissioners Court Order No. 97F,5 be in all matters rescinded and that the roadway across a portion of the George E. Ross property heretofore referred to as the Ashton Road be declared to be not a public roadway and it is further ordered that it will not hereafter be maintained by Kerr County in any manner as a roadway and it is further ordered that the Clerk
