Road 137 L'7n this the 8th ,lay of June, 1964 came on to be heard and considered by the Court the offer of L, K. `rench,Jr, , to donate 22.952 acres of land for Right- of-Way for X. M. toad 187 in Kerr County, together with four channel easements totaling 0.445 acres; and it appearing to the Court that it would be in the best in- tere~t of Kerr County 4o accept this pffer on the terms proposed, it is ordered on motio~ by Commissioner /~~ ` seconded by Commissioner /h~~~~ and unanimously approved by the Court that Herr County accept the offer of L. R. French, Jr. , to donate 21.952 acres of land ou,t of Surveys 16, 1633 and 1641 in Kerr County, together with the aforementioned 4 dlaaanehe~.sements and, that upon receipt of the executed right-of-way instru- mez~,ts; Kerr iounty, for and in consideration of this donation, will build a new fence g'~ortg 11 points on the new right-of-way line where there is no presently exis-tiara fee> said fence tq be of new materials and to conform to the following specificati sand conditions: 1. Heart cedar posts ~dth:~5 inch or better taps will be set 30 feet apart with 3 hearh ce~ar stays between and concreted all the way as follows: ifl inches in ynlid sock, 2 feet in dirt and corner posts 30 inches deep. All meta{ products to be, of domestic manufacture and fence to consist of 93q-1$-1~2 1/2 net wire with 1 smooth cable wire above and 1 below, 3, Kexx bounty will furnish 4 gates to Mr. E'rench's specifications using "Can't Sag" gates where requested, 4. Kerr County ~,aill erect an 3 foot wire fence from the north line of the Adam 44"ikon, Jr. , fence to tha proximity of the first gate to the north of safd fence line to protect the pen area around the relocated water trough. 5. k encing when completed to be subject to acceptance by L. k. ~: rench, Jr, , or his duly authori:.ed representative, with Kerr County 'withholding its final acceptance and payment for the said fencing pending receipt of a written release from Mr, r rench. It is further ordered that., as further consideration, FSerr County will do the following: 1, In co-ape ration with the (eras Highway Department, Kerr County will provide, at no cost to Mr, i%rench, a combi~n^ation drainage structure and stock pass to be located near station l'f" r} of the centerline of the new roadway, said structure to consist of an fl foot x 8 foot con- crete box approximately 104 feet in length, which structure shall be utilised for connecting pastures on each side of th<~ road, 2, Kerr County will relocated the existing eater trough on the north side of the present county road to a point near the present Adam vYilson, 3r. fence and connect the same with the present tank with a 1 1! Z inch galvanized pipe, properly cased under the roadway in a large pipe and will construct a wire livestock pen around floe water trough as per previous verbal agreement, 3, W"here necessary, Kerr County will erect temprary fencing along the present unfenced portions of the existing county roadway to keep the livestock of Mr, French within his pastures during the construction of the new roadway, 4, 1' oolowing completion of the new roadway, such portions of the existing county road kno'.vn as the.
