Cn this the 26th day of October, 1964, the Commissioners'
Court of Kerr County, Texas, convened in special session at the
Courthouse in the dity of Kerrville, Texas, ~.vith a quorum pre-
sent; and came on for consideration the written application of
Payne Grr and Leonard B. Brown to discontinue a certain public
road described as follows, to-wit:
Being located in the Riverside Park Subdivision of
Kerr County, Texas, according to the plat of said
subdivision of record in Volume 1, at page 70, Plat
Recorr':s of Kerr County, Texas; such roadway measur-
ing 4G feet in width and 522.7 feet in length; the
north line of same being the south boundary line of
Lots 33 through 37 of said Riverside Fark Subdivision,
and the south line of such roaaway being the north
boundary line of Lots 28 through 32 of said Riverside
Park Subdivision; such roadway commencing at the
Southeast corner of Lot 33 and the Northeast corner
of Lot 28, and terminating at the Southwest corner
of. Lot 37 and the North~.vest corner of Lot 32;
and it being found by the Court that the only dedication to pub-
lic use of such roadway is that conferrea by the recording of
the above-mentioned plat; that such roadway was not laid out
by a jury of view; that it was never opened for use; that no per-
son has any right or interest in and to such roadway by use,
necessity, contract or judgment; that Applicants are the owners
of all lands abutting upon such roadway, and that it would be
expedient and in the public interest to discontinue and close
the same, it is, therefore, upon the motion of Con;missioner Stone,
seconded by Commissioner Schwethelm, and upon the unanimous vote
of the Court, ORDERED that the above-described roadway be, and
the same i.s hereby, discontinued and closed.
