Order No, l0~fiS Offer to Jim Weatherby, Trustee, for Right-of-Way for State Highway 39 at Ingram On this the 3rd day of September, 1965, came on to be heard and considered by the Court the matter of compensation to be offered Jim Weatherby, Trustee, for the conveyance of right-of-way required for State Highway 39 at Ingram, and after due consideration by the Court, it is order- ed on motiun by Commissioner ~3ioner Bartel Schwethelm seconded by Gommis- and unanimously approved by the Court that Kerr County hereby offers to pay Jim Weatherby, Trustee, the sum of X375, 00 for land and damages as consideration for his conveyance to the ,~ ,_~tate of Texas in his fiduciary capacity of 0. 294 acres of land, being a portion of the Hill Country Arts Foundation Tract out of Survey 130, F, Trevino, on the west bank of Johnson Greek, with payment to be made upon approval by the Texas Highway Department of a deed properly executed by the said Jim Weatherby, Trustee, and upon the further execution of a partial release as to the land conveyed by the present holders of a certain vendor's lien original- ly retained by Mart Cole and Cecil Greer against the lands concerned, with payment being made before the conveyance is placed of record, and it is further ordered that upon approval of the instrument of conveyance and partial relase of vendor's lien by the Texas Highway Department, the Clerk and the 't'reasurer be authorized to draw a voucher on the Highway 39 Right-of-Way Fund in the amount of $375,00 payable to Jim Weatherby, Trustee, or payable in any such other manner as the said Trustee and/or present Vendor's Lien Holders may stipulate.
