M, ROAD 689 TO KERR COUNTY On this the 12th day of April, 1965, came on to be heard and considered by the Court the matter of disposition of three parcels of old right-of-way of F, M, Road 689 aggregating approximately 1,37 miles and situated in Kerr County, and it appearing to the Court that the designation of the following three parcels of right-of-way as a portion of the State Highway system has been cancelled by the terms of Texas Highway Commission Minute Order No, 55457 -- passed January 26, 1965, namely: 1. 1,490 acres of land more or less out of Wm, rdatt Survey No, 66 and Wm, Watt Survey 65 running from a point normal to centerline Station 179 to a point normal to centerline Station 186, said tract being described as Parcel No, 2 in "Appendix A" of this order. 2. 12.190 acres of land, more or less, out of Wm. 'watt Survey No. 65 and Wm, Watt Survey No, 64, one parcel running from near centerline Station 189 + 07.7 to a point normal to centerline Station 230+87 and another parcel running from a point normal to centerline Station 230+76,1 to a point normal to centerline Station 251+78,11, said two tracts being described as Parcels No. 3 and 4 in ^Appendix B" of this order; And it further appearing to the Court that the land comprising these three parcels of old right-of-way is no longer needed for the use of citizens as a road and that title to said Parcels 3 and 4 was originally acquired in the name of Kerr County at no cost to the State of Texas, and that title to Parcel No, 2 was originally acquired by Kerr County for the State of Texas at no cost to the State of Texas; and, It further appearing to the Court that as a portion of the consideration given by Kerr County incidental to the procurement of right-of-way for the State of Texas for use in re- location of F, M. Road 689, Kerr County did agree to reconvey to certain owners of record of abutting lands such portions of former F, M. 689 Right-of-Way as might be abandoned as public roadways, which agreements are a matter of record in the Minutes of the Court and specifically embrace the lands as described in Appendices "A" and "B" of this order, it is ordered on motion by Commissioner Mosty, seconded by Commissioner Schwethelm, and unanimously approved by the Court that on the basis of the facts hereinabove set forth, the Texas Highway Depart- ment and the State of Texas be requested to convey by Quitclaim Deed or otherwise to Kerr County, Texas, ail of the right, title, and interest of the State in the herein referred to three parcels of old Right-of-lday of F. M. Road 689 situated in Kerr County, which three parcels are more particularly described by metes and bounds in Appendices "A" and "B" of this order; and, It is further ordered that the Clerk of this Court furnish the Texas Highway Department with a certified copy of this order and the appendices thereto.
