X47 N0. 9972 ORDER REQUESTING TEXAS HI^1HWAY DEPARTMENT TO GRANT KERR CCUNTY FULL TITLE TO A ~.., PORTION OF OLD RIGHT-OF-WAY OF F. M. ROAD 689 On this the 12th day of April, 1965, came on to be heard and considered by the Court the matter of a portion of old right-of-way of F. M, Road 689 comprising 2.58L} acres of land out of J, A, Southmayd Survey No, 148 in Kerr County and constituting approximately 0,352 miles of roadway running from a point normal to centerline Station 90+05 to a point normal to centerline Station 106+18,9, and it appearing to the Court that the designation of the afore- said section of roadway as a portion of the State Highway system has been cancelled by the terms of Texas Highway Commission Minute Order No. 55457 passed January 26, 1965; and, It Further appearing to tho Court that title to the above referred to section of roadway was originally acquired in the name of Kerr County and that Kerr County did construct the original roadway thereon as a county road, and that said County Road as originally constructed became a portion of F, M, Road 689, which has now been removed from the State Highway system, and that Kerr County will have the responsibility of maintenance for the said roadway for so long as it may be used as a public roadway; and It further appearing that the closing of all or a portion of this roadway at a future date may likely be desirable due to common ownership of portions of the lands on both sides of the said roadway, thereby effecting a saving and convenience to all concerned; It is ordered on motion by Commissioner Mosty, seconded by Commissioner Schwethelm and unanimously approved by the Court, that on the basis of the facts hereinabove set forth, the Texas Highway Department and the State of Texas be requested to convey by Quitclaim Deed to Kerr County, Texas, all the right, title and interest of the State of Texas in the herein referred to section of old right-of-way of F, M, Road 689 situated in Karr County referred to as Parcel No. 1 and described more particularly be metes and bounds in Appendix "A" of this order; and, It is further ordered that the Clerk of this Court furnish the Texas Highway Department with a certified copy of this order and of appendix "A" hereto, APPENDIX "A" -- Field Notes Parcel No, 1 Control 421-5-8 F, M. 689, Kerr County Being 2.584 acres oŁ land, more or less, out of that certain tract of land lying in the John A. Holliman deceased, to Kerr County, dated May 19, 1937 recorded in Volume 61, Page 264-265 Dead Record of Kerr County, Texas, said 2,584 acre parcel being more particularly described by metes and bounds as follows: BEGINNING at a point in the existing east right of way line of F, M, Highway No. 689, said point being 60 feet from and normal to Station 90+05,0 on the centerline of F. M, Highway 689; THENCE NORTH 77° 42' East, 86,9 feet to a point, said point being in the east right of way line of F.
