On this the 23rd day of April, 1965, came en to be heard and considered by the Court
the matter of compensation to be offered Norma Massey, a feme sole, for the conveyance of
right-of-way required for State Highway 39 at Ingram, and after due consideration by the Court,
it is ordered on motion by Commissioner Schwethelm, seconded by Commissioner Stone and un-
animously approved by the Court that Kerr County hereby off'er•s to pay the said Norma Massey
the sum of 1,000.00 for land and damages as a consideration for her conveyance to the State
of Texas of 0.168 acres of land out of Survey No, 129, F, Trevino, in the town of Ingram,

such payment to be made upon approval by the Texas Highway Department of hsr properly executed
deed of conveyance, with payment to be made before the conveyance is placed of record; and,

J. D. BRA?3CE, Fetitioner, respectfully petitions this court for permission to use
portions of the streets and public ways in Guadalupe Heights, Guadalupe Heights No, 2 and
Guadalupe Heights No, 3, all subdivisions in Kerr Count, y, Texas, and duly platted as shown
by the Plat Records of Karr County, Texas, for the purpose of installing, improving and
maintaining the water system serving such subdivisions, in the manner and upon the conditions
following:
1. All excavations made in streets or other public ways used for travel shall be
immediately refilled and levelled,
2, All such cuts andfor excavations shall be compacted from time to time so as to keep
and maintain the same level with the surrounding surface,
3, The surface material of surfaced stroets shall be replaced in kind, whether such
^ surface is presently in place or shall be placed thereon in the future,
4, A11 water pipes and/or lines shall be buried a sufficient depth below the surface of
the ground to prevent any disturbance thereof by the maintenance of such siroets and ways by
the County or other governmental authority; and in no event shall the same be buried at a lesser
depth than 24 inches below the surface of the street, measured from such surface to the top
of such pipe or line,
5, The foregoing shall not apply to any lines or pipes which are presently installed in
such additions or any of them, except as the same may be replaced, relocated or repaired from
time to time by Petitioner,
6, Kerr County and its successors shall never have any liabilt~ for damage to, or
interference in, the operation, maintenance and/or installation of such pipes and lines, except
in the case of gross negligence, so long as Fetitioner shall comply with the conditions of this
petition.
