(CURTIS) COLBATH AND ruIFE, EULA COLBATH F'OR RIGHT-CF-6dAY FOR RIuHT_OF-WAY FOR STATE HIGHr~AY 39 AT INGRAM On this the lath day of June, 1965, came on to be heard and considered by the Court the matter of compensation to be offered Mrs, Eddie Lee Reagan and husband, Claude C, Reagan, Sr., and C, R, (Curtis) Colbath and wife, Eula Colbath for the conveyance of right-of-way required for State Highway 39 at Ingram; and after due consideration by the Court, it is ordered on motion by Commissioner Stone, seconded by Commissioner Schwethelm and unanimously approved by the Court that Kerr County hereby offers to pay the said Tors. Eddie Lee Reagan, as owner of record, and the said C, R, (Curtis) Colbath and wife, Eula Colbath, as the holders of an option to purchase the land concerned by virtue of an unrecorded contract of sale dated July 8, 1958, the total sum of v~2,800.00 for land and damages as consideration for their conveyance to the State of Texas of 0,192 acres of land out of Survey 129, F, Trevino, in the town of Ingram, it being stipulated that title to improvements bisected by the right-of-Way line shall vest in the State of Texas and that the owners shall retain title to the water well pump, equipment and pipes located on the premises convoyed and shall remove the same by August 1, 1965, unless left loner by agreement with the Texas Highway Department and it is ordered that payment of the consideration herein offered will be made upon approval by the Texas Highway ~~V Department of the owners' properly executed deed of conveyance, with payment to be made before the conveyance is placed of record, and it is further ordered that upon approval of the instrument of conveyance by the Texas Highway Department, the Clerk and the Treasurer be authorized to draw two vouchers on the Highway 39 Right-of-Way Fund as follows: 1. Voucher in the amount of $606.29 payable to ivtrs. Eddie Lee Reagan. 2. Voucher in the amount of w2, 193.71 payable to C. R. ALEXANDER AND WIb'E, ROXIE ALEXANDER, AND TO HILL COUNTRY FEDERAL SAVINGS AND LOAN ASSOCIATI011, INC., FOR R1:}HT-OF-WAY FOR STATE HIGHIVAY 39 AT INGRAM On this the 4th day of June, 1965, came on to be heard and considered by the Court the matter of compensation to be offered John E, Alexander and wife, Roxie Alexander, together with Hill Country Federal Savings and Loan Association, Inc., of Kerrville, Texas, as lienholder for tine conveyance of right-of-way required for State Highway 39 at Ingram, and after due considesa- tion by the Court it is ordered oti motion by Commissioner Stone, seconded by Commissioner Schwethelm and unanimously approved by the Court that Kerr County hereby offers to pay the said John E. Alexander and Roxie Alexander, as owners of record, and the said Hill Country Federal Savings and Loan Association, Inc., as lienholder, the total sum of $p 2, 660.00 for land and damages for the conveyance to the State of Texas by the said owners of 0.188 acres of land out of Survey 129, F. Trevino in the town of Ingram and the execution of a release of existing liens as to the said 0.188 acres of land by the said lienholder, it being stipulated that the owners shall retain title to one metal butane tank but shall remove the same from the promises conveyed by August 1, 1965, and that the owners shall retain title to that portion of the oxisting patio which extends onto the lands conveyed but shall remove the portion of the bisected improvement as extends onto the lands conveyed by August 1, 1965; And it is _°urther ordered that in addition to the cash consideration herein offered, Kerr County will, as additional consideration herein offered, Kerr County will, as additional consideration, provide a water line at least 1 1~2 inches in diameter to connect the owners existing water line to the linos of the Ingram Water Supply and Kerr County will also execute .-.. to the said John E, Alexander and Roxie Alexander a quitclaim deed to a portion of a public roadway known as Ballard Stroot, and authorize the closing of same, said quitclaim deed to embrace a strip of land 102 feet in length and averaging about 24 1~2 feet in width and comprising approximately O.G575 acres along the south side of owners present tract of land; And it is ordered that payment of the cash consideration herein offered will be made upon approval by the Texas Highway Department of the owners properly executed deed of conveyance and of the lienholders properly executed release of liens as to the lands conveyed, with payment to be made before the conveyance and release are placed of record, And it is further ordered that upon approval of Lhe instrument of conveyance and release of liens by the Texas Highway Department, the Clerk and the Treasurer be authorized to draw two vouchers on the Highway 39 Right-of-Way Fund as follows: 1. Voucher in the amount of X1,330.00 payable to John E. Alexander and Roxie Alexander. 2.
