On this the 18th day of June 1965, came on to ba examined by the Court the various claims
and accounts against Kerr County since the last term of Court, which claims and accounts were
approved for payment by the Clerk and Treasurer, in amounts and out of the Jury Fund and Road
and Bridge No. 1 Fund, as shown in the .4inutes of Accounts Allowed on Page 927, Voucher Nos.
" 12731 thru 12733, which were made a part hereof and of this order.
Motion made by Commissioner Stone, seconded by Commissioner Schwethelm and unanimously
approved by the Court,

N0. 10,019 OFFER TO H. L. SUBLETT FOR RIGHT-OF-WAY FOR STATE HIGHWAY 39 AT INGRAM
On this the pith day of June, 1965, came on to be heard and considered by the Court the
matter of compensation to be offered H, L, Sublett for the conveyance of right-of-way required
for State Highway 39 at Ingram, and after due consideration by the Court, it is ordered on
motion by Commissioner Stone, seconded by Commissioner Bartel and approved by a majority vote
with Commissioners Stone, Bartel and Mosty voting "Aye" and Commissioner Schwethelm voting
"No" that Karr County hereby offers to pay the said H, L, Sublett the sum of X7,000.00 for land
and damages as consideration for his conveyance to the State of 'Pexas of 2.743 acres of land
out of Survey 130, Y''. `Previno, west of Johnson Creel:, such payment to be made upon approval by
the Texas Highway Department of his properly executed deed of conveyance, with payment to be

made before the conveyance is placed of record;
And it is further ordered that upon approval of the instrument of conveyance by the Texas
~iighway Department, tho C1err: and the Treasurer be authorized to draw a voucher on the :3ighway

of-way roquired for State Highway 39 at Ingram; and after due consideration by the Court, it
is ordered on motion by Commissioner Stone, seconded by Comrnissionar Bartel and unanimously
approved by tho Court that Kerr County hereby offers to pay the said Pink Lee and Abby Lee the
sum of $1,000.00 for land and damages as consideration for their conveyance to the State of
Texas of G,198 acres of land out of Survey 129, F, Trevino, in the town of Ingram, such payment
to be made upon approval by the Texas Highway Department of their properly executod deed of
conveyance, with payment to be made before the conveyance is placed of record;
And it is further ordered that upon approval of tho instrument of conveyance by the Texas
Highway Department, the Clark and the Treasurer be authorized to draw a voucher on the Highway

Corporation, of San Antonio, Texas hereinafter called Lessor, and the County of Kerr, Texas,
a municipal corporation, acting herein through its Commissioner's Court, hereinafter called
Lessee,
WITHNESSETH:
That, Whereas, the Lessee requires the use of One New Caterpillar 922 Traxcavator,
Series B, Arr. 4K 3732, Serial No. 59A 5142, With Blower Fan, Powershift Transmission, Torque
Converter, Hydraulic Boosted Steering & Brakes, Fenders, Lighting System, 15.5 x 25 12 Front
& Hear Tuneless Tires, 1}Y. 9070 BucY.et, 4K 7143 Bucket Teeth, and 3K 6731 Extension, in Kerr
County, Texas,

1. Lessor, in consideration of the payments of rentals hereinafter mentioned, hereby
leases to the Lessee: One New Caterpillar 922 Traxcavator, Series B, Arr, 4K 3732, Serial No,

Steering & Brakes, Fenders, Lighting System, 15,5 x 25 12 Front X Rear Tubeless Tires, (}K 9070
Bucket, tiK 7143 Bucket Teeth, 3K 6731 Extension, for a period commencing the 1st day of June,
1965 and ending the 1st day of June, 1970 for a total rental of SEVENTEEN TIIGUSAIdD FGU1Z HUNDRED
EIGHTY FOUR AND 00100 ($r17,484.OG) DOLLARS, payable as follows: Trade Allowance for Allis
Chalmers TDI2 Loader, Serial No, 1682, *3,984,00. The remaining balance of THIRTEEN THOUSAND
FIVE HUNDRED AND OO~1G0 (:13,500.00) DOLLARS payable as follows:
X2,700.00 due on or before June 1, 1966

2. The Lessee acknowledges receipt of said equipment in good order and condition and
obligates itself upon the expiration of this lease, in the event the option herein referred
to has not been exercised, or in the event that it shall default in the performance of any of
tYie terms, covenants and conditions hereof, and Lessor elects to terminate this ccntract as
hereinafter provided for, to thereupon deliver said machinery to Lessor, freight prepaid, at
Lessor's warehouse in San Antonio, Bexar County, Texas, in the sa:~ie good order and condition
as when received by Lessee, ordinary wear and tear only accepted,
