NTEEICr:R, City-County Sanitarian, P,eport for November, 1967 o-o-o-o-o-o-o-o-o-c N0. 10131 ORDER Ai'PROVING USE AGREET~NT FOR SOUTHWEST AIRLINES ANll OrHERtti'ISE COTdCURR1NG WITH CITY OF I~RRVILLE TO USAGE OF LOUIS SCHREINER FIELD On tnis the 13th day of December, 1965 came on to be heard and considered by the Court the Use Agreement for Southwest Airlines as heretofore approved by the City of Kerrville; and after duo consideration, it is ordered on motion by Commissioner Stone, seconded by Commissioner Mosty and unanimously approved by the Court that Kerr County approve the proposed Use Agreement as submitted and heretofore approved by the City of Kerrville and that Kİrr County further concur with the proposal of the City of Kerrville to accept a previous payment of $2120.00 by Southwest Airlines as compİnsation for the airlines use of Louis Schreiner Fisld through November 30, 1965; and it is further ordered that the Clerk certify the necessary copies of this order and record the said exocuted Use Agreement in the minutes of the Court. o-c-o-o-c-e-o-o-o-o USE AGREEPTENT TTiis Use Agreement is between the City of Kerrville and County of Kerr, joint ownors of Louis Schreiner Airport, sii;uated in Kerr County, Texas, party of first part, and Southz~est Airlines, Inc., of San Antonio, Texas, party of Second part, ARTICLE I - PREMISES Party of first part hereby agrees that party of second part may use, at Louis Schreiner Airport and jointly with others, the runways, taxi-ways, rarap~s, and airport lights used for aircraft operations, and other public conveniences for flying,, landings and takeoffs of ~~f, aircraft o£ party of second part, which shall include: "" 1, The operation of a regularly scheduled transportation system by aircraft for the carriage of persons and property, 2. The right to load and unload persons and property incidental to such operation. ARTICLE II - SERVICES The facilities of Kerrville Flying Service shall be used by party of second part for sale of its tickets and other usual terminal building services, but parties of first and socond part may by mutual afireement in writing at any time designate any other area at Louis Schreiner Airport and any other facility and/or agent for sale of such tickets and the rendi- tion of such services. ARTICLE III - TERM This Use Agreement shall begin December 1, 196!x, and shall remain in effect for three months. ARTICLE IV - FEES Party of socond part shall pay party of first part a landing fee of Ten Dollars 0 10.00) per month, payable monthly in advance to the City of Kerrville during the torm of this azJree- ment and for the considerations stated herein, ARTICLE V - RULES &: REGULATIONS Party of second part agrees to observe all rules and regulations promulgated and enforced by party of first part (not in conflict witY'. the provisions hereof), along with the applicable provisions of the Federal Aviation Rao lations. ARTICLE VI - RIGHTS OF U. S. GOVERIQNLENT If the U, S, Government takes over the airport in case of National emergency, this agreement shall terminate at that time, ARTICLE VII - LIAT3ILITY Party of second part agrees to save and keep harmless party of first part of and from any and all liability arising from, or caused by, the negligent or willful acts or omissions of party of second part, its agents, servants and employees, in connection with the use of .~ the Louis Schreiner Airport premises hereunder, to effoctuate which party oi' second part shall carry liability insurance in amounts of not less than $100,000,00 per passenger and w1,000,U00,OC single limit.
