fixing the fees of Special Commissioners in Eminent Domain Proceedings filed within Kerr
County, 'Pexas; and it appearing to the Court that by virtue of Article 326b Section 3 as
amended, the duty has vested upon the Court to set aside such fees, at a sum of not less than
w10.U0 for each day said Commissioners are engaged in the performance of their duties, it is
therefore Ordered that effective this date the fee of such Special Commissioners in Eminent
Domain Proceedings filed in Kerr County, Texas be, and is set at the sum of `Pen Dollars

PUBLIC LIBRARY SERVICES THROUGH ITS OPLRATiON OF 'I'HF: rROPOSED BtiTT-HOLDSWORTH

On this the 13th aay of December, 19b} came on to be heard and considered by the Court
the matter of an agreement with the City of Kerrville whereby Kerr County would contract with
the City of Kerrville i'or the rendition of Public Library Services to the residents of Kerr
County through and by the operation and maintenance by the City of the proposed Butt-Holds-
worth Memorial Library; and after due consideration by the Court of the benefits which wculd
accrue to ail of the residents of Kerr County from such an agreement, it is ordered on motion
by Commissioner Mosty, seconded by Coirunissioner Schwethelm and unanimously approved by the
Court that Kerr County hereby offers and agrees to contract with the City of Kerrville for
such services upon the following terms and conditions, to-wit:
1. The Commissioners Court will contract with the City of Kerrville for the renait~on of
Public Library Services to the citizens of Kerr County within the scope of she legal authority
of Article 169~~, Vernon's Annotated Texas Civil Statutes.
2. Legal title, control ana management of the proposed Butt-Holaswortn Memorial Library,
hereinafter referred to as the facility, shall be vested in ana remain the sole responsioility
oY ohe City of Kerrville.
3, As consideration to be paid the Ci~y for their rendition of Public Library Services, Kerr
County will contract to pay the City of Kerrville fifty per cent of the city's acT.ual opera-
tional and maintenance costs incurred during each fiscal billing year as hereafter designated;
subject, however, to the limitations sat forth in the following item Plumber 5.
L}. The term Fiscal Billing Year shall be defined as a period of 12 ca~endar months commencing
on October 1 ana ending on the ioilowing Septemoer S0, witu the rirst much Fiscal Billing Year
r- commencing on Octooer 1, 19b6. The designation of such Fiscal Billing Year is intenaed to
coincide with Kerr County's Tax Cosloction Year.
}. Kerr County's agreed par~icipation in fifty per cent of the maintenance ana operational
costs of the facility shall be limited in terms of dollars by an amount representing, the actual

net as valorem tax collections during each tax collection year as will accrue from a levy of
five cen~s on the ~~lUU.DO valuation on the Kerr County `Pax Roil.
6, The proposed tax levy by Karr County of five cants on the w100,00 valuation will be made
as a portion of Kerr County's 1966 "Pax Levy and will be levied annual ly so long as the proposed
contract remains in force and shall not be ro:Iueed so long as the entire amount so levied and
collected sha7.1 be reasonably necessary to defray one-half of the operating and maintaining the
facility,
Commencing with Kerr County's Tax Collection year beginning October 1, 1966 the not monies
collected pursuant to the agreed tax levy will be placed in a separate Fublic Library Fund by
the County Treasurer of Kerr County, and upon proper billing from time to time, the Commission-
ers Court shall authorize payments to the City of Kerrville for expenses actually incurred
during the then current Fiscal Billing Year. In the event that one-half' of the City of
TCerrvzlle's actual cost of the operation and maintenance of the facility exceeds the monies,
including delinquent taxes, paid into the Public Library Funa during any given Fiscal Billing
Year, such excess costs shall not constitute a claim against monies paid into the said Public

Library Fund during the next succeeding or any subsequent Fiscal i~illi.ng Year,
8. If construction oŁ the proposed facility has not been commenced or contracted for by 3uly
1, 1966, Karr County may elect not to levy and collect the proposed five cents on the X100.00
valuation for Public Library purposes; however, proceeds of such a levy, if made on the 1966
Tax Roll shall be paid into the Public Library Fund of the County Treasurer commencing October
1, 1966, even though the facility may not have become operational at that time.
9. It is stipulated that Kerr County will, in January, 1966, pursuant to its existing contract
with the Kerr County Memorial Library, make its already budgeted payment to the said library
for renaition of Public Library Sorvlcos Łor 1966; nowover, Korr County proposes to terminate
its existing Library Contract with the Kerr County Memorial Library upon the anticipated merger
of its operational facilities with the proposed Butt-Holdsworth Memorial Library.

On this the lath day of llecember, 1965 came on to be heard and considered by the Court
the offer of Presbyterian Mo-Ranch Assembly to donate 5.555 acres of land for right-of-way for
F, ii, Road ljl+0 extension and relocation and after due consideration by the Court, it is
ordered on motion by Commissioner Stone, seconded by Commissioner Bartel ana unanimously approv-
ed by the Court that Kerr County accept the offer or Presbyterian Mo-Ranch Assembly, a corpora-
tion, to donate 5.555 acres of land out of Surveys 1b55 ana 11+76 for right-of-:-ray for F, TAT.
Road 131}0 extension and relocation and that in consideration of such donation Kerr County will
fence both sides of the right-of-way donated with a livestock fence consisting of new materials,
including 39 inch net wire topped by two smooth cable wires and will provide two entrance gates
and in addition to the foregoing consideration, Kerr County will, after completion of the
reconstruction and relocation of F, rI, Road 131~U by the Texas Highway Department, request tine
said Hignway Department to close and abandon as a public roadway that portion of existing F,
M, Road 134v commencing at the present Mo-Ranch entrance and running east to the point of `
intersection with the new route of F, TAI, Road ljl}0; and, upon such closing, request the State
of Texas to quitclaim the said abandoned right-of-way to Kerr County, and Kerr County will then
in turn quitclaim the said abandoned right-of-way to those landowners who originally convoyed
the same to the State of Texas at no cost to Kerr County; and, pursuant to the assent granted
