Library Fund during the next succeeding or any subsequent Fiscal Billing Year. 8. If construction of the proposed facility has not been commancsd or contracted for by July 1, 1966, Kerr County ma;,* elect not to levy and collect the proposed five cants on the j?100.00 valuation for Public Library purposes; however, proceeds of such a levy, if made on the 1966 Tax Roll shall be paid into the Public Library Fund of the County Treasurer commencing October 1, 1966, even though the facility may not have become operational at that time. Cullom, the ... sum of w1,32j,00 compensation for land and damages as consideration for their conveyance to the State of Texas of 13.1119 acres of lane out of Surveys 1354 ana 1655 ana for tneir granting of one channel easament comprising 0,21E.5 acres out of Survey 1351+ and in addition to the fore- going cash consideration, Karr County will, prior to commencement of construction of the new roadway, construct on both sides of the right-of-way granted, a dear- goof fence consisting of cedar posts set 30 feat apart with throe 7 1~2 foot 3~fi" diameter corrugated steal stays between each post, with the wire consisting of two courses of 939-12-12 if 2 net wire topped with one smooth cable wire and, in conjunction with said fencing, Kerr County will relocate the existing entrance gate at Bee Cave Creek and provide two additional entrance gates of equivalent quality on opposite sides of the roadway in the proximity of Station~8 of the centerline as well as two entrance gates on opposite sides of the roadway between station 20 and 20150 of the centerline and all existing fencing on the right-of-way conveyed will be by Korr County with salvaged materials being left for use by the property owners; and further Kerr County will case and if necessary relocate the existing water line crossing the roadway at Boa Cave Creek; .., and provided further that in addition to the other consideration herein offered, Kerr County will, after construction of the new roadway, request the Texas Highway Department to close and abandon as a public roadway that portion of the existing route of F, M, Road lj!{0 beginning at the present Mo-Ranch entrance and running east to the point of intersection with the new roadway at Boe Cave Creek and, upon such closing, request the State of Texas to quitclaim the said abandoned right-of-way to Karr County and Karr County will than in turn quitclaim to Frank P, Cullum, Sr., that portion of said abandoned right-of-way which he originally conveyed to the State o£ Texas at no cost to Kerr County; and further upon the closing and abandonment of said old roadway, Kerr County will remove the existing right-of-:day fencing along the north side of said roadway with salvaged materials being left for use of the property owners and will relocate the existing entrance on the north side of the present right-of-way at a point across the end of the abandoned right-of-way and Kerr County will also close the resulting gap in the existing river bank fencing which will result at the east and of the existing Mo-Ranch ;^ bridge. Kerr County will also, upon request, clear a combination livestock passage way and jeep road up the south bank of Boo Cave Creek at the nearest point to the south right-of-way lino of the new roadway where the terrain will permit an ordinary bulldozer to feasibly accomplish such clearing and will, upon request, extena such clearing along the top of the Bee
