ROAD 13L}0 On this the 13th day of r~:comber, 1965 came on to be heard and considered by the Court the matter of compensation to be paid Frank P. Cullum, Sr., and wife, Edith Y, Cullum, for their conveyance to the State of Te:cas of 13.149 acres of land and granting of one channel easement comprising 0.?i{5 acres, whir.h land and easement are required for the construction and reloca- tion of F, T~Y, Road 131}.0; and after due consideration by the Court, it is ordered on motion by Com:-nissioner Stone, secunaed by Commissioner Mosty and unanimously approved by the Court that Kerr County hereby offers to pay Frank P, Cullum, Sr., and wife, Edith Y. Cull'am, the .-. sum of X1,325,00 compensation for land and damages as consideration for their conveyance to the State of Texas of 13.11T9 acres of land out of Surveys 1354 and 1655 ana for tneir granting of one channel easement comprising 0.21E5 acres out of Survey 1354 and in addition to the fore- going cash consideration, Kerr County will, prior to commencement of construction of the new roadway, construct on both sides of the right-of-way granted, a deer-proof fence consisting of cedar posts set 30 feet apart with throe 7 1/2 foot 3ffi" diametor corrugated steel stays between each post, with the wire consisting of two courses of 939-12-12 if 2 net wire topped with one smooth cable wire and, in conjunction with said fencing, Kerr County will relocate the existing entrance gate at Bee Cave Creek and provide two additional entrance gates of equivalent quality on opposite sides of the roadway in the proximity of St at ion~8 of the centerline as well as two entrance gates on opposite sides of the roadway between station 20 and 20+50 of the centerline and all existing fencing on the rightrof-way conveyed will be by Karr County with salvaged materials being left for use by the property own©rs; and further Kerr County will case and if necessary relocate the existing water line crossing the roadway at Boe Cave Creek; and provided further that in addition to the other consideration hersin offered, Kerr County will, after construction of the new roadway, request the Texas Highway Department to close and abandon as a public roadway that portion of the existing route of F, M, Road ljt}0 beginning at the present Mo-Ranch entrance and running east to tiie point of intersection with the new roadway at Boe Cave Creek and, upon such closing, request the State of Texas to quitclaim the said abandoned right-of-way to Kerr County and Korr County will then in turn quitclaim to Frank P, Cullum, Sr., that portion of said abandoned right-of-way which he originally conveyed to the State of 'Pexas at no cost to Kerr County; and further upon the closing and abandonment of said old roadway, Kerr County will remove the existing right-of-:oay fencing along the north. side of said roadway with. salvaged materials being left for use of the property owners and will relocate the existing entrance on the north side of the present right-of-way at a point across the end of the abandoned right-of-way and Kerr County will also close the resulting gap in the existing river bank fencing which will result at the east end of the existing Mo-Ranch "" bridge, Kerr County will also, upon request, clear a combination livestock passage way and jeep road up the south bank of Bee Cava Creak at the nearest point to the south right-of-way line of the new roadway where the terrain will permit an ordinary bulldozer to feasibly accomplish such clearing and will, upon request, extena such clearing along the top of the Beo ~~~ Cave Creek bluff to the new right-of-way lino, and construct a drift fence of standard height approximately b0 yards in length from the new right-of-way line on the north end of the Bes Cave Creek bluff and running south to where the top of the bluff becomes perpendicular and in additi^n Karr County will modify the fencing and gates of the present livestock holding pens at Bee Cave Creek so as to provide adequate access for trailer trucks from the relocated entrance gate to the loading chute pens and in conjunction herewith furnish an additional pen gate and make all necessary adjustments in road and fencing alignments, And it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher in the amount of X1325,00 on the F, M. 13110 Right-of-Way Fund payable to Frank P, Cullum, Sr., and Edith Y, Cullum, to be delivered to them upon their execution of the ha rein reŁerrad to Right-of-delay Deed and Channel Easement. o-o-o-o-o-o-o-o-o-o N0. 101){.0 ORDER ACCEPTING PROPOSALS OF GABRIEL MATA TO CONSTRUCT FEIiCING ALONG F. ICI. ROAD 1340 AND AUTHORIZING i'ARTIAL PAYMENPS FOR P'EIQCING ACTUALLY CONSTRUCTED On this the 13th day of Decombor 1965, came on to be heard and considered by the Court three separate proposals of Gabriel Mata to construct the three ailferent types of fencing required for F, M, Road 13L}0 extension and relocation and it appearing to the Court after reviewing the various proposals submitted that each of the three proposals of Gabriel Mata represent the lowest and best proposal for each of the three typos of fencing, it is ordered on motion by Commissioner Schwethelm, seconded by Commissioner Bartel and unanimously approved by the Court that the three Following separate proposals of Gabriel Mata for the aforesaid fence construction be accepted, Proposal No. One-to construct approximately 8,729 feet of standard livestock fencing across the Mo-Ranch, Burke and Carson properties: `vfi595.00 per mile with one gate per mild and extra gates N25.00 each, Proposal No. Two-to construct approximately 9,100 feet of Dear Proof fencing with cedar posts across the Cullum Ranch: X875.00 per mile with one gate per mile and extra gates :35,00 each. Proposal No, Tykes-to construct approximately 3200 feet of Deer Proof fence wiffiereosote posts across a portion of the Kerr Wildlife Management Area according to State Specification wU,53 per yard with one gate and additional gates w35.00 each (Equivalent of w932,80 per mile). And it is further ordered that the said Gabriel Mata shall be entitled to partial payments for each of these three sections of fencing from time to time, the said partial payments to be limited to the estimated percentage of completion less 15o and it is further ordered that the Clerk and the Treasurer be authorized to draw vouchers on the F.
