Order No, 10, 062 Order Amending and Extending the Term of Lease Dated January 10, 1963 between the City of Kerrville and Kerr County, Lessors, and Mooney Aircraft, Inc., Lessee On this the 3rd day of September, 1965, came on to be heard and considered by the Court a proposed amendment and extension of the lease term of a certain lease between the Gity of Kerrville and Kerr County as Lessors and Mooney Aircraft, Inc. , Lessee, dated January 10, 1963 and recorded in Vol. L, P. 598 of the Minutes of the Commissioners Court of Kerr County, which lease concerns a portion of the Gity-County Airport property; and it appearing to the Court that a portion of the proposed ex- tension of the area covered by the lease and the proposed extension of the term of said lease are reasonable and in the best interests of the people of Kerr County, it is ordered on motion by Commissioner Stone, seconded by .. Commissioner Bartel, and unanimously approved by the Court that Kerr County grant the requested amendments to the aforesaid lease, insofar as the request to extend the existing area of tract two of said lease northward is concerned and as to the basic term of the lease, but not grant the request to extend existing tract No, 2 to include a. portion of the present public use area in the proximity of the southeast corner of Tract No. 2; And it is further ordered that the County Judge be authorized to execute the said lease amendment for and on behalf of Kerr County, with the said amendment including an extension of the term of the lease to run for a period of 40 years, commencing on such date in the year 1965 as may be acceptable to the City of Kerrville and the Lessors; provided, however, that the authority herein granted to execute the said lease shall be exercised only upon concurrence of the Gity of Kerrville herein and upon the further condi- tion that Mooney Aircraft, inc, , shall first have secured a lease from the Kerr County Industrial Foundation of an adjacent 35.2 acre tract of land known as the Peterson Tract; and it is further ordered that the Clerk furnish such certified copies of this order as may be required and that upon final exe- cution of the said lease amendment by all parties, it be recorded in the Minutes of the Court.
