HGAD 131{.0 ~~ On this the 11th day of April 1966, came on to be heard and considered by the Court the s necessity of instituting condemnation proceedings against Eugene T, Standley and wife, Elizabeth Standley, residents of Bexar County, `T'exas, to secure for the State of Texas three ~~ parcels of land consisting of 5,568 acres of land out of the following Surveys located in Kerr County, Texas: 3.673 acres Survey 1355, S. H, Larrimore, 1.896 acres Survey 1549, GC ~ SFRR Co, and to further secure for the State of Texas one Channel Easement comprising 0.115 acres out of S. ;I, Larrimore Survey 1355; and It appearing to the Court that the offer for land and damages made to the said Eugene T, Standley as is evidenced by Commissioners' Court Order IQo. 10189 entered on the 17th day of February 1966 and recorded in Vol, M, Yage 346 of the Minutes of this Court has been rejected by the said Eugene T, Standley, acting through his attorney Hon. Joe Burkett, Jr „ and It further appearing to the Court that the rejection of this and all other offers by Kerr County has left the parties concerned in a position of being unable to agree as to the amount of compensation to which the said Eugene T, Standley and wife, Elizabeth Standley are entitled to receive for the said tracts of land and damages which would accrue by reason of their conveyance, and it further appearing to the Court that Tlill Country Federal Savings and Loan Association, Inc, of Kerrville, Texas, as lien holder as to the aforesaid lands has executed and delivered a Partial Release of its liens against the afor°esaid lands and further waived all claims against any compensation to be paid the said Eugene T. Standley for the Right-of-Way concerned, and It further appearing to the Court that further negotiations would be useless and to no avail, it is therefore ordered on motion by Commissioner Schwethelm, seconded by Commissioner T~fosty and unanimously approved by the Court that Korr County, acting for and on behalf of the State of Texas against the said Eugene T, Standley and wife, Elizabeth Standley of Bexar County, 'Pexas to secure for the State of Texas for Right-of-lday Purposes the aforementioned 5.568 acres of land and to further secure for the State of Texas for purposes of a Channel Easement the use of the aforesaid 0.115 acres of land, said tracts of land being described and shown more particularly on the Right-of-Way T°Sap of the Texas Highway Department as approv- ed October 28, 1965, covering a portion of F M Road 1340 from 1.0 miles East of MO Ranch West through Kerr Wildlife Management Area, to which map reference is herewith made; and It is further ordered that County Attorney Robert H, Barton bo retained to institute such condemnation proceedings and that he be authorized and directed to proceed forthwith on ~ _ ^.. behalf of Kerr County, acting for and in the name of the State of 'Pexas.
