P~I. 1{OAD 131}0 On this the 12th day of April, 1966, came on to be heard and considered by the Court the matter of amending Order No. 10,189 heretofore entered by the Court or. the 17th day of February, 1966, and it appearing to the Court after due consideration that the said Eugene T. Standley and wife, Elizabeth Standley, have agreed to convey the required right-of-way and channel easement on certain terms which are acceptable to Kerr County and that the said Order Ido. 10,189 should be amended accordingly, it is ordered on motion by Commissioner Stone, seconded by Commissioner Schwethelm and unanimously approved by the Court that Order No. 10,189 as encored by the Court on the 17th day of February, 1966, and l~aco.~°ded in Volume Psi, Page 31L6 of the Minutes of the Court be amended to include the following terms in Kerr County's offer to the said Eugene T. Standley, et al: 1. Karr County offers to pay Eugene 'P, Standley and wife Elizabeth T, Standby the sum of 2,500,00 compensation for land, damages and severance damages as consideration for their conveyance of the required 5,568 acres of land and granting of the required channel easement comprising 0.115 acres of land, with payment to be made directly to them by virtue of the fact that Hill Country `r'ederal Savings and Loan Assn,, Inc,, as lienholder has granted a partial release as to its liens against the lands concerned and has by letter waived all claims as to compensation to be paid by Kerr County therefor, 2, In lieu of the 3 proposed entrance gates on the south side of the right-of-way convey- ed, Kerr County will erect 3 cattle guards and three 12 foot steel gates at the following locations: a, On the existing North Fork County Road at a point immediately west of the point where the present Stowers Ranch Road intersects the said North Forlc Road, with this cattlo guard to be installed within 30 days of the delivery of the executed right-of-way conveyance. b. In the south right-of-way line of the new roadway across the end of the old county roadway in the proximity of Station 170+90, c. In the south right-of-way line of the new roadway across the end of the old county roadway in the proximity of Station 207+30. r^ 3, In addition to closing those remaining segments of tho existing aublic roadway known as the North Fork Road between the Stowers Ranch Road and a point opposite Station 217+50 of the centerline of the new roadway, Kerr County will, in event of the extension of F, ICI, Hoad 131E0 westward from the end of the right-of-way conveyed, propose to close remaining portions • ~~ of the existing county roadway across the Standley property west of station 221+90 of the new roadway. 4. Kerr County will undertake to secure the approval of the Texas Parks and tilildlife Commission and eventual legislative authority for the exchange of approximately 2,922 acres of the Standley property for approximately 2.647 acres of State property so as to eliminate small severed tracts of land belonging to the said parties, and it is agreed that final docision as to fencing along these sevored areas will be deferred pending the possible consuma- tion of such proposed exchange, 5.
