~~~ I?0. 10352 ORDER AMENDING ORDER N0. 10314, OFFER TO W. G. POWELL AND WIFE, LOUISE POWELL, AND HILL COUNTRY FEDERAL SAVINGS AND LOAN ASSOCIATION, INC., FOR RIGHT-OF-WAY -. FOR F. M. ROAD 783 On this the 14th day of November, 1966, came on to be heard and considered by the Court the matter of a counter offer made to Kerr County by W. G. Powell and wife, Louise Powell, in response to Kerr County's offer to them for Right-of-Way for F. DI. Road 783 as set forth in Order No. 10314 entered on the 30th day of September, 1966; and it appearing after due consideration by the Court that an equitable settlement can be arrived at on the basis proposed, it is ordered on motion by Commissioner Schwethelm, seconded by Commissioner Stone and unanimously approved by the Court that said Order No, 10314 be amended to read that Kerr County offers to pay the sum of $2,000.00 as consideration for land and damages; and in addition will pay the sum of $133.64 as the estimated cost of constructing 748 feet of standard livestock fencing, the said payment plus $50.00 for one gate to be made to the owners in lieu of Kerr County's original offer to fence the right-of-way conveyed and further that the one inch plastic water line referred to in Order No. 10314 be extended to a point 25 feet east of the east right-of-way line and a water trough installed at that .-- point; And it is further agreed that the right-of-way deed concerned be held in escrow by the County Judge of Kerr County until the owners have had an opportunity to remove the top soil from the proposed right-of-way area, provided that the County Judge shall not be required to hold said deed in escrow beyond December 15, 1966; And it is further ordered that the said Order No. 10,314 be amended so as to authorize the Clerk and the Treasurer to draw a voucher on the F. M. 783 ROW Fund in the amount of $2,183.64 payable to W. G. Powell, Louise Powell and Hill Country Federal Savings and Loan Association, Inc., the said voucher to be delivered upon delivery into escrow of the duly executed Right-of-Way Deed and Partial Release executed by the lienholder. o-o-o-o-o-o-o-o-o-o N0. 10353 ORDER AMENDING ORDER N0. 10307, OFFER TO SYLVIA REES McBRYDE AND HUSBAND, R. CLAY McBRYDE, FOR RIGHT-OF-WAY FOR F. M. ROAD 783 On this the 14th day of November, 1966, came on to be heard and considered by tY_e Court the matter of amending Order No. 10307 heretofore entered by the Court on the 23rd day of September, 1966, and recorded in Vol. M, Page 391 of the Minutes of the Court; and i.t appear- ing to the Court that the said Sylvia Rees McBryde has offered to convey the 0.751 acres of land required for right-of-way for a total cash consideration of $901.2C and that it would be in the best interests of Kerr County to accept the said offer, it is ordered on motion by Commissioner Mosty, seconded by Commissioner Bartel, with Commissioners Mosty and Bartel voting "aye", Commissioner Schwethelm voting "no", and Commissioner Stone abstaining. Motion carried by a majority vote that the said Order No. 10307 be amended so as to offer the sum of $901.20 for the said conveyance; and that the Clerk and Treasurer be authorized to draw a voucher on the F. M. 1340 R/W On tris the 14th day of November 1966, upon motion made by Commissioner Schwethelm, seconded by Commissioner Bartel, the Court unanimously approved that the Clerk and Treasurer be authorized to draw vouchers on the F.
