Td00RE FUR RIGHT-OF-WAY FOR F. .~. ROAD 783 On this the 12th day of December, iy66, came on to be heard and considered by the Court the necessity of amending Order No. 10325 entered by the Court on the 10th day of October, 1y66, it having been ascertained that a portion of the proposed 1.457 acre Right-of-6Jay ~~ Tract referred to in said order was not in fact a portion of the Tom J. I~loore tract and that only 1.228 acres of land out of the Tom J. Moore tract are necessary for right-of-way for the reconstruction of F. M. Road, it i.s ordered on motion by Commissioner Stcne, second- ed by Commissioner Bartel and unanimously approved by the Court that Order No. 10325 be amended so that Kerr County offers to pay Tom J. T+Ioore the sum of X1,500.00 for his convey- ance to the State of Texas of 1.228 acres of land out of Survey 120, but retaining the building on the land conveyed; and in addition to the foregoing cash compensation, Kerr County will convey to the said Tom J. Moore all of its remaining right, title and interest in the adjacent 0.50 acre tract cf land heretofore conveyed to Rerr County by J. W. Rasmus, et ux, by deed recorded in Vol. 1.76, Page 90, Kerr County Deed Records and out of which Kerr County has heretofore conveyed 0.229 acres of land, more or less, to the State of Texas for right-of-way purposes; and in addition, Kerr County will, in co-operation with the Texas highway Department, reconstruct and extend the present entrance driveway so that the grade will not exceed the present grade and will repave the same; and It is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the F. ICI. 783 ROP/ Fund in the amount of 01,500.00 payable to Tom J. Moore to be deliver- ed on receipt of the duly executed Hight-of-Play Deed and that the County Judge be authorized to execute a Warranty Deed in the name of Kerr County as to the remaining interest of Kerr County in and to the aforesaid 0.50 acre tract of land described in Vol. 126, Page 90, Kerr County Deed Records, the said conveyance to Tom J. ROAD 689 On this the 12th day of December, 1966, came on to be heard and considered by the Court the matter of compensation to be paid E. W. Brown, Jr., for land and damages for the conveyance of land required for the reconstruction of F. Iii. Road 689; and after due consideration, it is ordered on motion by Commissioner Schwethelm, seconded by Commission- er N:osty and unanimously approved by the Court that Kerr County hereby offers to pay E. W. Brown, Jr., the sum of X627.30 for his conveyance to the State of Texas of 4.182 acres of land out of Surveys 1582, 574 and 1822; and it appearing to the Court that the said E. W. Brown, Jr., desires to construct his own fencing along the right-of-way conveyed, it is ordered that in addition to the foregoing cash consideration now tendered, Kerr County will subsequently pay the said E. W. Brown, Jr., the cash equivalent of labor and material costs which would have been incurred by Kerr County to construct along the said right-of-way a standard type livestock fence consisting of heart cedar posts set 25 feet apart with 3 heart cedar stays between posts and 832-12-12 1/2 net wire and 3 barb wires; and It is further ordered that the Clerk and the Treasurer draw a voucher on the F.
