said contract will no longer be required for use as a public road following the propoeed
reconstruction of F. M. Road 689; therefore, the Texas Highway Department is hereby request
ed to convey the following 2.410 sore tract of surplus right-of-way to J. W. Young, Jr.,
and wife, Louise Flack Young, pursuant to the terms oŁ the contract entered into by the

On this the 30th day of December, 1966, came on to be heard and considered by the
court the matter oY compensation to be paid E. C. Hubble, Individually and as Trustee for

right-ofrway conveyed ae follows:
1. Along approximately 9,550 feet of right-of-way, Kerr County will conetruot a
standard type livestock fence ooneisting of pressure treated creosoted pine po eta with 5 to
6 inch tope net 25 feet apart with 3 heart cedar et aye between sad 832-12-12 1/2 net wire
and 3 barb wires.
2. Along approximately 1,470 Łeet of right-of-way now fended deer proof, Kerr County
will erect similar fencing with pressure treated creosoted pine po ata with 5 to 6 iaoh tope
set 30 feet apart and 4 heart cedar stays between with two aouraee oŁ 939-12-12 1/2 net
wire topped by one smooth oable wire.
3. Two existing wire entrance gates on the west side oŁ the present roadway will be
relocated on the new right-of-way line es will the exi et ing cattle guard and entrance on th~
roadway to the Hubble residence and the existing nearby wooden entrance gate will be replac~
ed with a new metal entrance gate of similar height.
It 1s further ordered that the Clerk and the Treasurer be authorized to drew a voucher
on the F. M. 689 No. 2 Hight-of-Way Fund in the amount of 44,000.00 payable to E. C. Hubble
Individually and E. C. Hubble, Tru et ee, the said voucher to be delivered upon receipt of the
duly executed Right-of-Way Daed end Channel Easement executed by E. C. Hubble, Individually
and as Trustee.
