Offer to Frances P. Burke for Right-of-Way for
F. M. Road 1340
On this the 7th day of January, 1966 came on to be heard and considered
by the Court the matter of compensation to be paid Frances P, Burke for her
conveyance to the State of Texas of 0.491 acres of land, which land is required
for the construction and relocation of F, M. Road 1340; and after due considera-
ti``on by the Court, it is ordered on motion by Commissioner Saone ,
seconded by Commissioner Bartel and unanimously approved
bI) the Court that Kerr County hereby offers to pay Frances P, Burke the sum of
$ 00. 00 compensation for land and damages for her conveyance to the State of
exas of 0.491 acres out of Surveys 1476 and 1655, and in addition to the fore-
going cash consideration, Kerr County will construct a new fence along the
entire south, west and north sides of the remainder of the 3 acre Frances P,
Burke tract, including within such enclosure an additional tract of approximate-
ly 0. 125 acres in event its conveyance is made to the said Frances P, Burlce by
Robert R. Carson, et al, with it being stipulated that the fencing be of a standard
livestock type of net wire and heart cedar posts and stays as constructed on the
adjacent property by Kerr County, and in addition Kerr County will provide one
12 foot metal entrance gate, aluminum if available, to be installed at a location
acceptable to the owner and the Texas Highway Department; and it is further
ordered tnat in addition to tiie foregoing consideration, Kerr County will endeavor
to secure conveyance to the said Frances P. Burke of approximately 0. 125 acres
of land out of Survey 1655 by Robert R. Carson, et al, at no cost to the said
Frances P. Burke, provided however, in thee~ent Kerr County is unable to secure
conveyance of the aforesaid 0, 125 acres of land, the cash compensation herein-
before set forth shall be increased to $400.00, and it is further ordered that
upon the delivery of a properly executed deed of conveyance to the State of Texas
of tue herein referred to 0.491 acres of land, the Clerk and the Treasurer be
authorized to draw a voucher on the F. M. 1340 Right-of-Way Fund payable to
Frances P, Burke in the amount of $300. 00, or in the alternative, if circum-
