Read 1340 On this the 12th day of April, 1966, can7e on to be heard and considered by the Court the matter of amending Order No, 10, 189 heretofore entered by the Court on t,e 17th day of February, 1966, and it appearing to the Court after due consideration thattne said Eugene T, Standley and wife, Elizabeth Standley, have agreed to convey the required right-of-way and channel easement on certain terms wiricii are acceptable to Kerr County and that the said Order No. 10, 189 should be amended accordingly, it is ordered on xnotion by Commissioner Stone, seconded by Commissioner Schwethelm and unanixnously approved by the Court that Order No. 10, 189 as entered by the Goart on the 17th day of February, 1966, and record- ed in Vol, M, Page 346 of the Minutes of the Court be amended to include the following terms in Kerr County's offer to tae said Eugene T. Standley, et al: 1, Kerr County offers to pay Eugene T, Standley and wife Elisabeth T. Standley the sum of $2, 500. 00 compensation for land, damages and severance damages as consideration for their conveyance of the re- quired 5. 568 acres of -and and granting of the required channel easement comprising 0. 115 acres of land, with payment to be made directly to there by virtue of the fact that hill Country Federal Sav- ings and Loan Assn„ Inc., as lienholder has granted a partial re- lease as to its liens against the lands concerned and has by letter waived all claims as to compensation to be paid by Kerr Gouuty therefor, L, In lieu of the 3 proposed entrance gates on the south side of the right-of-way conveyed, Kerr County will erect 3 cattle guards and three 12 foot steel gates at the following locations: a, On the existing North Forlc County Road at a point immedi- ately west of the point where the present Stowers Ranch Road intersects the said North Fork Road, with this cattle guard to be installed within 3C days of the delivery of the executed right-of-way conveyance. b, in ttie south right-of-way line of the new roadway across tiie end of the old county roadway in the proximity of Station 17090. c, In the south right-of-way line of the new roadway acrosa the end of the old county roadway in the proximity of Station 20"1E30, 3, In addition to closing those remaining segments of the existing public roadway known as the North Fork Road belxween tiie Stowers Ranch Road and a point opposite Station 217f50 of the centerline of the new roadway, Kerr County will, in event of the extension of F. M. Road 1340 westward from the end of the right-of-way conveyed, propose to close remaining portions of the existing county roadway across the Standley property west of station 2L1~90 of the new roadway, 4, Kerr County will undertake to secure the approval of the Texas Paria and Wildlife Commission and eventual legislative authority for the exchange of approximately 2, 9:=Z acres of the Standley property for approximately 2, b47 acres of State property so as to eliminate small severed tracts of land belonging to the said parties, and it is agreed that final decision as to fencing along tt,ese severed areas will be deferred pending the possible consumation of such proposed exchange. 5, it is further ordered that the Gleri: and the Treasurer be autInorized to draw a voucher on the F. M. 1340 Right-of-Way Fund in the amount -, of $Z, 500.00 payable to Eugene T.
