OADEA N0. 10,277 This the 8th day of August, 1966, at the regular meeting of the Commissioners' Court of Kerr County, Texas, with a quorum present, came on to be considered the matter of Kerr County's selling <3nd disposing of its undivided one-half (%) interest in and to a certain tract of 51.69 acres of land out of the County's undivided one-half (%) interest in and to approximately 367.36 acres of land commonly known as the "Louis Schreiner Field" or "Municipal Airport"; and it being found and determined by the Court that the present location of the airport facilities offers virtually no room for expansion and that it cannot be enlarged to meet the greater demands for service in the future; that aircraft parking on the grassy areas between the runway and the building restriction line is in violation of the clearance requirements of the Federal Aviation Agency for Kerr County's category of airport; that aircraft parking space is inadequate and unavailable near the present airport installation for expansion purposes, but that an aircraft parking area is proposed for the other side of the runway adjacent to the proposed taxiways and proposed terminal buildings; that the proposed relocation of public facilities on the other side of the present airport would promote the public safety, inasmuch as airplanes would be able to move from hangars or the proposed terminal building to the parking area and directly to the proposed taxiways without having to cross the runway; that at virtually all airports the terminal facilities serve as a focal point about which are located light industry, aircraft maintenance and private hangars which are an essential part of providing service to the general public using the airport; that much of the aforesaid services to the general public cannot be made available at the present location due to its limited space and crowded conditions; and that a sale of the County's interest in the -1- tract of land hereinafter described will make available to the County funds for the future development of the improved airport facilities, in promotion of the public health, welfare and safety; upon the motion of Commissioner W. C. Schwethelm of Precinct No. One, seconded by Commissioner Adolph Bartel of Precinct No. Three, all members of the Court present voting in favor of the motion and none voting against, Commissioner C. H. Mosty of Precinct No. Two being absent, it is accordingly, ORDERED by the Commissioners` Court that A. P. Allison be and he is hereby appointed Commissioner to sell and dispose of Kerr County's undivided one-half (%} interest in and to the hereinafter-described real estate to the highest bidder for cash at a public auction to be held at the courthouse door of the County Courthouse in the City of Kerrville, Kerr County, Texas, at 10:00 o'clock A.M. on the 6th day of September, 1966, such real estate being described as follows, to-wit: An undivided one-half (%) interest in and to all that certain tract or parcel of land lying and being situated in the County of Kerr, State of Texas, comprising 51.69 acres of land being approximately 50.55 acres out of Original Survey No, 71, Wm. T. Crook, Abstract No. 114, and 1.14 acres out of Original Survey No. 1921, W. M. Pruitt, Abstract No. 1281, out of the Kerrville Munici- pal Airport property and being more particularly described by metes and bounds, as follows, to-wit: BEGINNING at an iron stake set 300.0 feet NW from the center line of the NE-SW runway and 500.0 feet NE from the center line of the NW-SE runway of said airport, set for the South corner of this tract, said point being located approximately 1100 feet N. 52° 30' E. from the lower or South corner of said Original Survey No. 71, Wm. T. Sieker, doing business as Kerrville Flying Service; reserving, however, unto Kerr County all of the County's one-half ('~-z) undivided interest in and to the water supply system, airport light system, communica- tions system and other equipment located on, in, under or above said property essential to the use of the airport facilities, including a general perpetual easement therefor; and reserving unto Kerr County and the General Public the right to use the air space above the surface of the premises hereinabove described for the flight and passage of aircraft in said air space, together with the right to cause in said air space such noise as may be inherent in the operation -4 - of aircraft now known or hereafter used for navigation of, or flight in, when using said airspace or landing at, taking off from, or operating any such aircraft; and, further, the reservation to Kerr County to take any action necessary to prevent the erection or growth of any structure, tree or other object into the air space above the tract herein described, and to take any action necessary to cause Purchaser to remove from such air space or mark and light as obstruc- tion to air navigation, any and all structures, trees, or other objects that may at any time project or extend above the mean sea level elevation of 1584; that such sale shall be subject, however, to the following exceptions and reservations, to-wit: (1) All bids shall be subject to rejection or approval by the Commissioners' Court of Kerr County, Texas, within thirty (30) days from the date of such sale; (2) There shall be reserved unto Kerr County an easement sixty (60) feet in width parallel with and adjacent to the north boundary of the airport; and (3) Such sale shall be subject to the rules, regulations and require- ments of the Federal Aviation Agency. The reservation unto Kerr County and the general public for airport usage in and to said 6.68 acres above described until June 1, 1985, shall mean that the purchaser of such tract shall have only the right to receive the One Dollar ($1) per year rental, if any, as is provided in said lease to Robert E. Sieker; shall have no right to enter into possession of said 6.68 acres until June 1, 1985, except that Such purchaser may enter upon such premises as a member of the general public; shall make no alterations or additions as is provided in paragraph 13 of said lease to Robert E. Sieker unless the same is also with the advice and written approval of the purchaser, Robert E. Sieker, doing business as Kerrville Flying Service, and Kerr County first obtained; subject to the lease of Robert E. Sieker, Kerr County shall exercise exclusive control over the use and enjoyment of said 6.68 acre tract until June 1, 1985, at which time the said purchaser shall have the right to enter into full and complete possession, use and enjoyment of said 6.68 acres, except for such conditions, limitations and reservations as the Commissioners' Court of Kerr Gounty may deem necessary and other reservations, all as -5- herein provided; the Purchaser's said right to enter into full possession and enjoyment of said 6.68 acre tract may be accelerated by a mutual written agreement executed by Kerr County, the purchaser, and Robert E. Sieker or their successors or assigns. All proceeds received by Kerr County from the sale of said airport property above described or portion thereof shall be deposited in a special fund designated the "Kerr County Airport Fund", which proceeds, together with any other revenues from the airport, shall be appropriated solely to, and used by Kerr County for, the purposes of planning, developing, constructing, improving, maintaining, equipping, operating, regulating, protecting and policing the airport and air navigation facilities.
