Order No. ~`~~ Order Requesting Texas Highway Department to Convey a Parcel of Old Right-of-Way of State Highway 39 at Ingram to Kerr County On this the 13th day of February, 1967, came on to be heard and con- sidered by the court the matter of dispostion of a parcel of old Right-of-Way of State Highway 39 at Ingram in Kerr County; and it appearing to the court that the designation of the said parcel of old right-of-way as a portion of the State High- way System has been cancelled by the terms of Texas Highway Commission Minute Order No. 58435 dated October 3, 1966, which parcel of land constitutes 0, 360 acres of land out of F, Trevino Survey No. 130 as described in Appendix "A" of this order; and, It further appearing to the court that the land comprising this parcel of old right-of-way is no longer required for the use of citizens as a road and that the said parcel of old right-of-way constitutes a portion of a former county roadway, which became a portion of the State Highway System at no cost to the State of Texas and that it should now be returned to Kerr County, it is ordered on motion by Commissioner % ~,~.-/,_~~j.,, seconded by Commissioner ~J~t~, and unanimously approved by the court that the Texas Highway Department and the State of Texas be requested to convey by quitclaim deed to Kerr County, Texas, all of the right, title and interest of the State in the herein referred to parcel of old Right-of-Way of State Highway 39 situated in the town of Ingram in Kerr County, which parcel is more particularly de- scribed by metes and bounds in Appendix "A" of this order. APPENDIX "A" Being 0.360 acres of land more or less, out of that certain 5 3/5 acre tract ~f land lying and being in the Francisco Trevino Survey No. 130, Abstract No. 333, in Kerr County, Texas, said 5 3/5 acre tract being the same land de- scribed in a deed from T. J. Moore to Victor H. Davis and wife, Ila Jean Davis, dated June 24, 1964, recorded in Volume 118, Page 472-473, Deed Records of Kerr County, Texas; said 0.360 acre parcel of land being more particularly de- scribed by metes and bounds as follows: BEGINNING at the point of intersection of the south right-of-way line of existing State Highway 39 `Kith the northeast right-of-way line of State Highway 39 to be abandoned, said point being in a southwesterly direction 253.0 feet from an existing northeast corner of the Victor H. Davis, et ux property, and being further described as being 80.0 feet at right angles from Engineer's Station 208381,9 on the centerline of said existing State Highway 39; THENCE along the northeast right-of-way line of said highway to be abandoned as follows: SOUTH 40°37' East, 41.4 feet; SOUTH 63°51' East, 70, 5 feet; SOUTH 73°12' East, 53, 5 feet; SOUTH 78°25' East, 198.8 feet; THENCE SOUTH 2°15' West, 40.0 feet to a point, said point being in the southwest right-of-way line of said highway to be abandoned; THENCE along the southwest right-of-way line of said highway to be abandoned as follows: NORTH 78°25' West, 207.1 feet; NORTH 73°12' West, 59.8 feet; - -NORTH 63°51' West, 81.6 feet; THENCE NORTH 40°37' West, a distance of 81.0 feet to a point in the 'existing south right-of-way line of State Highway 39, said point being 80.0 "fed,t Erom and normal to Engineer's Station 208330.4 on the centerline of State Highway 39; THENCE NORTH 88°23' East, along existing south right-of-way line of State Highway 39, a distance of 51.5 feet to place of beginning and contain- ing an area of 0.360 acres of land, more or less.
