traverse the lend presently owned by the said Mrs. Bennett (Frencee) Heap and George Alfred
Heap, it ie ordered on motion by Commissioner Bartel, aeco nd ad by Oommieaioner 9chwethelm
and unanimously approved by the court that Kerr County accept the eforeeaid pro poeal and
that Kerr County pro Deed to enter into the necessary three party oontre et to implement the
aforesaid proposal; and
It is further ordered that prior to the oo net ruction of the new roadway, Kerr County
will erect a standard type liveatook fence along the right-of-way oonveyed to the State
of Texas by the said Mrs. Bennett (Francee) Heap and George Alfred Heap, which fence shall
consi et of posts set 25 feet apart with 3 heart cedar et ays between and 832-12-12 1/2 net
wire and 3 barb wireo; and in addition, it is further ordered that that portion of abandon-
ed F. M. 689 Right-of-Way to be re conveyed by the State of Texas is hereby ordered closed
and abandoned as a public roadway effective upon the execution of the necessary conveyance
by the Governor of the State of Texas, together with that segment of the former Turtle
Creek-Center Point County Road lying between the aforesaid abandoned right-of-way of F.
M. Road 68y and the present route of F. M. Road 2771, and upon such abandonment, Kerr Count,
will close the fence along the west ends of the two segments oP roadway so abandoned, end
inat all one 12-foot metal entrance gate on the west end of the former F. M. Road 689 Right-
of-Way.

FLORINS PEARSON FOR RIGHT-OF-WAY AND CHANNEL EASEMENT FOR F.M. ROAD 689
On this the 20th day of January, 1967, came on to be heard and oonaidered by the court
the necessity of instituting condemnation proceedings against Calvin W. Fearson and wife,
Florins Pearson, to secure for the State of Texas two parcels of land con atituting 4.027
acres of land, more or less, being 0.236 sores, more or leas, out of W. T. Crook Survey
No. 61, 2.523 acres, more or less, out of F. A. Sawyer Survey No. 109 and 1.268 scree, more
-. or less, out of F. Gomel Survey Ao. 547, together with one ohannel easement constituting
0.172 acres of land out of W. T. Crook Survey No. 61; and,
It appearing to the court that the offer for land and damages made to said Calvin W.
Pearson and Florins Pearson by Kerr County as ie evidenced by Commissioners Court Order
No. 10,420 entered on the 9th day of Jenua ry, 1967, and reoorded in Vol. M, Page 434 of
the Minutes of the Commissioners Court has been re~eoted by the said Calvin W. Pearson and
wife, Florins Pearson; and,
It further appearing to the court that the reject ion of Kerr County's final offer has
left the parties Donee reed in a position of being unable to agree as to the amount of
compensation to which the said Calvin W. Pearson and Florins Pearson are entitled to recei~
for the said pa rce la of land end channel easement and damages which would accrue by reason
of their conveyance; and,
It further appearing to the court that further negotiations would be useless and to
no avail, it is therefore ordered on motion by Commissioner Bartel, seconded by Commis-
{~~ sinner Burney, and unanimously approved by the Court that Kerr County, acting for end on
behalf of the State oŁ Texas, In et itute ooncennat ion proceedings in the name of the State
of Texaa against the said Calvin W. Pearson and Flo rine Pearson to secure for the State
of Texas for right-of-way purposes the eforeeaid 4.027 scree of land, together with the
I aforesaid 0.127 sore ohann.el easement, which land and channel easement are described and
chewy. more particularly on the Right-oŁ--Way Map of the Texee Highway Department es approved
on November 29, 1966, covering a portion of F. M. Road 689 from 5.6 miles southeast of St at
Highway 16 to a point 6.0 miles south, to which reference is herewith made; and,
It ie Further ordered that County Attorney Robert R. Barton be retained to institute
such condemnation proceedings and that he be authorized and directed to proceed Forthwith /Q/J
