be accepted as the lowest and best bid for fencing material along F. M. Road 689, as per

for construction of fencing along F. M. Road No. 689 be accepted as the lowest and beat
bid, as per specifications on file in the office of the County Clerk.

1967; and 1t appearing to the court that in order to adequately compensate the said Calvin

Pearson end wife, Florins Pearson, for those damages accruing ae a result of their granting
,- the required right-o£-way, a total of $6,250.00 should be offered as compensation for land
and damages, it is ordered on motion by Commissioner Rurney, seconded by Commissioner Stone,
and unanimou sly approved by the court that the said Order No. 10,420 be amended so as to
increase the amount of cash compensation offered the ea id Calvin Pearson and wife, Florine
Pearson, to $6,250.00, with the Clerk end the Treasurer being authorized to draw a voucher
on the F. M. 689 No. 2 Right-of-Way Fund in this amount and as set forth in the said
original order; and,
It is further ordered that Kerr County will request the Texas Highway Department to
reconvey to the said Calvin Pearson end wife, Florine Pearson, such surplus right-of-way
es may be found to exi at from the proximity of pass Creek northward and abutting the present
Pearson property, and upon the reconveyance o£ any surplus right-of-way, Kerr County will
furnish the necessary fencing materiels to fence the reconveyed right-of-way to the same

N0. 10436 ORDER REQUESTING THE TEXAS HIGHWAY DEPARTMENT TO CONVEY SURPLUS RIGHT-OF-WAY OF
F. M. ROAD 689 TO MRS. BENNETT (FRANCES) HEAP AND GEORGE ALFRED HEAP, PURSUANT
TO THEIR AGREEMENT TO CONVEY NEW RIGHT-OF-WAY
On this the 27th day of January, 1967, came on to be heard and considered by the court
the necessity of implementing a proposed contract between the Texas Highway Department,
Kerr County, and Mra. Bennett (Frances) Heap and George plf red Heap, whereby certain surplus
right-of-way of Farm-to-Market Road 689 is to be conveyed by the State of Texas to Mra.
Bennett (Frances) Heap and George Alfred Heap in exchange for their granting a right-of-way
deed to the State of Texas as to 3.415 acres of land out of W. T. Crook Survey No. 61 and
W. T. Crook Survey No. 62, which tract of land is particularly described by metes and bounds
in Exhibit "A" to said pro po aed contract; end, after due consideration by the court, it is
ordered on motion by Commissioner Schwethelm, seconded by Commissioner Bartel, end unanimous
ly approved by the Court that Kerr County enter into the proposed contract and that the same
be signed by the members o£ the court; and it ie further ordered by the court that the 6.409
- acres of land out of Surveys 61, W. T. Crook, and 62, W. T. Crook, as described in Exhibit
^B" to said contract will no longer be required for use ae a public road following the pro-
posed reconet ruction o£ F. M. Road 689; therefore, the Texas Highway Department ie hereby
requested to convey the following 6.409 acre tract of earplus right-of-way to Mrs. Bennett
(Frances) Heap and George Alfred Heep pursuant to the terms of the contract entered into by
the three parties concerned:
