BURNEY COMMISSIONER, Precinct No. 2; ADOLPH BARTEL COMM11ISSIONER, Precinct No. 3; ROGER STONE COMMISSIONER, Precinct No. 4; I and with the following absent: none, when among other proceedings had by sa ld Commissioner ' Court were the following: There came on to be considered the returns oŁ an election held in KERR COUNTY COMMON SCHOOL DISTRICT N0. 2 (INGRAM) of Kerr County, Texas, on the 28th day of January, 1967, to ' determine whether the Commissioners' Court of $err County, Texas, shall have the power to issue bonds of said District to the amount oŁ 540,000 for school building purposes within the limits oŁ said District, to-wit: the purchase, construction, repair or equipment of ~', public free school buildings and the purchase oŁ necessary sites therefor, and whether there shall be annually levided end collected on all taxable property in said District a tax sufficient to pay the current interest on said bonds and to pay the principal thereof as the same becomes due, pursuant to the authority of Article 2784e-1, V.A.T.C.S.; and WHEREAS, upon consideration of the returns of said election, it appears that the same was in all respects legally held after due notice had been given and that said returns were duly and legally made; and WHEREAS, it appears from said returns that in respect oŁ the proposition to issue bond of said District, there were cast at said election 201 votes "FOR THE ISSUANCE OF BONDS AND ' THE LEVYING OF THE TAX IN PAYMENT' THEREOF", and 47 votes were cast ^AGAINST THE ISSUANCE OF BONDS AND THE LEVYING OF THE TAX IN PAYMENT THEREOF"; therefore I'1' IS FOUND AND DECLARED AND SO ORDERED BY THE COMMISSIONERS' COUR^1 OF KERR COUNTY, TEXAS: SECTION 1: That the aforesaid election was duly end legally celled and notice thereof given in accordance with the laws of the State of Texas and the order calling said election tt3at said election was held in strict conformity with the Constitution and laws of the ', State oŁ Texas, and the returns thereof have been properly made to the officials of the ~, Diet rict entitled to receive same; and that only resident qualified property taxpaying ,^ '. electo re oP the said Di et rict, who own property therein subject to taxation and who have duly rendered the same for taxation, were permitted to vote at said election; and, further, that said election properly repre sente the desi rea oŁ those qualified to vote as aforesaid. ~' SECTION 2: That a majority of the resident qualified property taxpaying electors of the District, voting at said election, voted in favor of the issuance oŁ $40,000 school building bonds and the levying of a tax on all taxable property in said District sufficient i ' to pay the current interest on said bonds and to pay the principal as the same becomes due, ' pursuant to authority of Article 2784e-1, V.A.T.C.5.; and, therefore, this Commissioners' Court ie authorized to issue said bonds and to levy, assess and collect said tax. The above order having been read in full, it was moved by Commissioner Stone end seconded by Commissioner Burney that the same be passed and adopted. Thereupon, the I, question being called for, the County Judge put the motion to a vote of the members of the Commissions ra' Court, and the motion carried by the following vote: Commissioners Schwethe lm, Burney, Bartel and Stone; and noIIe voting "NO".
