Schwethelm Adolph Bartel Roger Stone County Judge Commissioner Precinct 1 Commissioner Precinct 3 Commissioner Precinct 4 and the Court having duly opened, the following proceedings were had: N0. 10472 ORDER GRANTING CONSENT TO MOONEY AIRCRAFT, INC., TO SUBLET AREA WITHIN BUILDING LOCA'PED ON CITY-COUNTY AIRPORT PROPERTY On this the 17th day of March, 1967 came on to be heard and considered by the Court the request of Mooney Aircraft, Inc. to sublet an area approximately 8 feet by 20 feet in its Building No. 9 situated on the City-County Airport Property, and it appearing to the Court that the request is reasonable and that the City of Kerrville has heretofore granted its consent to the said proposed subletting, it is ordered on motion by Commissioner Schwethelm, seconded by Commissioner Bartel and unanimously approved by the Court that Kerr County join the City of Kerrville in the matter of granting its consent to the pro- posed sublease as requested by Mooney Aircraft, Inc., and it is further ordered that the County Judge be authorized to execute the necessary consent agreement on behalf of Kerr ~~ County and that the same be recorded in the Minutes of this Court as an appendix to this order. CONSENT TO SUBLET STATE OF TEXAS ~ COUNTY OF KERR ~ WHEREAS, in Section 13 of that certain lease agreement dated January 23, 1963, by and between the City of Kerrville and the County of Kerr hereinafter called Lessors and Mooney Aircraft, Inc., hereinafter called Lessees, it is necessary for Lessees to obtain the written consent of Lessors prior to the subletting of any of the demised premises; and, WHEREAS, Mooney Aircraft, Inc., determines that it is to its advantage to have certain areas within the confines of its buildings set aside and made readily available for the storage of propellers, spinners, prop governors and other aircraft parts Łor use in manufacture of aircraft; and, WHEREAS, Mooney Aircraft, Inc., respectfully requests that the City of Kerrville and the County of Kerr consent to subletting of a small area, approximately S ft. by 20 ft ., located in the southwest corner of Building No. 9 to Lawrence Warehouse Company for the purpose of warehousing and supplying propellers, spinners and prop governors, for the sum of X1.00, for a term not to exceed a period of one year. NOW, 'THEREFORE, KNOWN 'PO ALL MEN BY THESE PRESENTS, that the City of Kerrville, a municipal corporation of the County of Kerr, State of Texas, and the County of Kerr, State of Texas, a governmental subdivision of the State of 'Texas, each acting by and through its duly authorized officers, do hereby consent to Mooney Aircraft, Inc., subletting to Lawrence Warehouse Company, an area approximately II ft. by 20 ft., in the southwest corner of Building No. 9 for the purpose of warehousing and supplying propellers, spinners and prop governors, for the sum of $1.00 for a term not to exceed a period of one year. FURTHER, the City of Kerrville and the County of Kerr, 'Texas, do and by these presents hereby waive their Lessors privilege, pledge and pawn within the said premises subleased, the true intent being that all property stored in the sublet premises shall at all times be free and clear of all claims, liens and privileges of every nature and kind whatsoever which Lessors may now or hereafter have which might now or hereafter prime or outrank any and/or all warehouse receipts issued by Lawrence Warehouse Company, its successors and assigns, covering goods now or hereafter placed in said sublet premises so long as any or all of said warehouse receipts remain outstanding, except such lien or claim said Lessors may have by virtue of their being the holder and/or owner of any or all of said warehouse receipts.
