Offer to Calvin W. Pearson and Wife, Florine Pear-
son, for Land and Damages for Right-of-Way for F,
M. Road 689
On this the 9th day of January, 1967, came on to be heard and consider-
ed by the court the matter of compensation to be paid Calvin W, Pearson and
wife, Florine Pearson, for 4.027 acres of land out of Surveys 61, 109 and 547,
together with one channel easement comprising 0. 172 acres out of Survey 61,
which land and channel easement are required by the reconstruction of F. M,
r due consideration by the court, it is ordered on motion by

and unanimously approved by the court that Kerr County

land out of Surveys 61, 109 and 547, together with their grant-

tood"that the said Calvin W. Pearson and Florine Pearson shall retain
title to one frarreresidence, one butane tank, all pipes and plumbing, together
with all associated appurtenances thereunto in anywise pertaining and also to
all fencing ahd other improvements of any character situated on the land con-
veyed, provided that all improvements shall be removed from the new right-
of-way by March 1, 1967, it being the agreement of the parties that the compen-
sation herein offered shall be in full and final settlement of the costs of remov-
ing and relocating the said improvements and for all damages resulting there-
from or from the conveyance of the lands herein referred to; and in addition to
the foregoing cash consideration, Kerr County will construct a new livestock
fence along the new right-of-way line, which fence shall consist of heart cedar
posts set 25 feet apa.r+.,,ith 3 heart cedar stays between and 832-12-12 1/2 net
wire with 3 barb wires; and
It is further ordered that the Clerk and the Treasurer be authorized to
draw a voucher on the F. M, 689 No. 2 Right-of-Way Fund in the amount of
$~DDD.d,s payable to Calvin W, Pearson and Florine Pearson, the said
voucher to be delivered upon receipt of their duly executed Right-of-Way Deed
and Channel Easement.
