Order Directing Condemnation Proceedings Against
Calvin W. Pearson and Wife, Florine Pearson for
Right-of-Way and Channel Easement for F, M, Road
689
On this the 20th day of January, 1967, came on to be heard and con-
sidered by the court the necessity of instituting condemnation proceedings
against Calvin W. Pearson and wife, Florine Pearson, to secure for the State
of Texas two parcels of land constituting 4.027 acres of land, more or less,
being 0. 236 acres, more or less, out of W, T. Crook Survey No. 61, 2, 523
acres,' more or less, out of F. A, Sawyer Survey No, 109 and 1.268 acres,
mare or less, out of F. Gomez Survey No, 547, together with one channel
easement constituting 0. 172 acres of land out of W. T. Crook Survey No. 61;
and,
It appearing to the court that the offer for land and damages made to
said Galvin W. Pearson and Florine Pearson by Kerr County as is evidenced
by Commissioners Court Order No. 10, 420 entered on the 9th day of January,
1967, and recorded in Vol. M, Page 434 of the Minutes of the Commissioners
Gourt_has been rejected by the said Calvin W. Pearson and wife, Florine
Pearson; and,
It further appearing to the court that the rejection of Kerr County's
final offer has left the parties concerned in a position of being unable to agree
as to the amount of compensation to which the said Calvin W, Pearson and
Florine ,Pearson are entitled to receive for the said parcels of land and channel
easerent and damages which would accrue by reason of their conveyance; ~~and,
It further appearing to the court that further negotiations would be
useless and to no avail, it is therefore ordered on motion by Commissioner
Bartel, seconded by Commissioner Burney, and unanimously approved by the
court that Kerr County, acting for and on behalf of the State of Texas, institute
condemnation proceedings in the name of the State of Texas against the said
Calvin W, Pearson and Florine Pearson to secure for the State of Texas for
right-of-way purposes the aforesaid 4.027 acres of land, together with the
aforesaid 0.127 acre channel easement, which land and channel easement are
described and shown more particularly on the Right-of-Way Map of the Texas
Highway Department as approved on November 29, 1966, covering a portion
of F. M. Road 689 from 5.6 miles southeast of State Highway 16 to a point
6.0 miles south, to which reference is herewith made; and,
It is further ordered that County Attorney Robert R. Barton be retain-
ed to institute such condemnation proceedings and that he be authorized and
directed to proceed forthwith on behalf of Kerr County, acting for and in the
came of the State of Texas.
