Order No. 10,439 Order Requesting the State of Texas to Convey Surplus Right-of-Way of F. M. Road 1340 to Presbyterian Mo- Ranch Assembly On this the 27th day of January, 1967, came on to be heard and con- sidered by the court the matter of reques+.ing the State of Texas to convey a parcel of surplus right-of-way constituting a portion of the former route o£ F. M. Road 1340 to Presbyterian Mo-Ranch Assembly, a corporation; and it appearing to the court that the portion of right-of-way concerned which constitutes 0.90 acres of land, more or less, out of H. E. & W, T. R. R. Co. Survet~• No. 1655 is no longer required for use as a public road- way; and, It further appearing to the court that the said Presbyterian Mo-Ranch Assembly has heretofore granted certain right-of-way to the State of Texas for ,the relocation of F. M. Road 1340 and that as a portion of the considera- tion for the granting of the said right-of-way, Kerr County did agree to re- q~nest the State of Texas to reconvey the said 0.90 acres of land to the said Presbyterian Mo-Ranch Assembly as is evidenced by Commissioners Court Order No. 10, 318, dated December 13, 1965, and duly recorded in the minutes of the court; and, _ It further appearing to the court that the said 0.90 acres of former right-of-way were procured by Kerr County for the State of Texas at no 'cost to the State of Texas, It is ordered on motion by Commissioner Stone, seconded by Gommis- sinner Bartel and unanimously approved by the court that Kerr Gounty here- by requests the State of Texas to reconvey the aforesaid 0.90 acres of land as are more particularly described in Exhibit "A" to this order to Presby- terian Mo-Ranch Assembly, a corporation, for the reasons herein set forth. EXHIBIT "A" Being 0.90 acres of land, more or less, out of that certain tract of land lying in the H. E, & W, T. R. R. Co. Survey No. 1655, Abstract No, 914, Kerr County, Texas, said 0.90 acre tract being the same land de- scribed in a deed from Presbyterian Mo-Ranch Assembly to State of Texas dated May 18, 1950, recorded in Volume 89, Page 442, Deed Records of Kerr County, Texas; said 0.90 acre parcel of land being more particularly described by metes and bounds as follows: BEGINNING at the point of intersection of the northwest right-of-way line of abandoned F. M. Highway 1340 with an easterly line of the Presby- terian Mo-Ranch Assembly property, said point being an existing interior corner of the said Presbyterian Mo-Ranch Assembly property, and being further described as being 35, 0 feet at right angles from Engineer's Station 55934, 0 on the centerline of abandoned F. M. Highway 1340; THENCE NORTH 56°02' East, parallel to and 35.0 feet from the center- line of abandoned F. M. Highway 1340, a distance of 284.8 feet to a point at right angles from Engineer's P. T. Station 556E49.2 on the centerline of said abandoned Highway; THENCE in an easterly direction along the arc of a circular curve to the right, having a radius of 228, 18 feet, concentric with and 35, 0 feet from the centerline of said abandoned highway, a distance of 124, 5 feet to end of curve at right angles from Engineer's P. C. Station 55543,8 on the center- line of abandoned Highway; THENCE NORTH 87°40' East, parallel to and 35, 0 feet from the center- line of abandoned F. M, Highway 1340, a distance of 190, 3 feet to a point at right angles from Engineer's Station 55353.5 on the centerline of said abandon- ed Highway, said point being also the center of the North r ork of Guadalupe River; THENCE SOUTH 29°10' West, with the center of North Fork Guadalupe River, 82, 1 feet to a point, said point being 35, 0 feet at right angles from Engineer's Station 55396.5 on the centerline of said abandoned Highway; THENCE SOUTH 87°40' West, parallel to and 35, 0 feet from the center- line of abandoned F. M. Highway 1340, a distance of 147.3 feet to a point at right angles from Engineer's P. G. Station 55543.8 on the centerline of abandoned F. M, Highway 1340; THENCE in a westerly direction along the arc of a circular curve to the left, having a radius of 158, 18 feet, concentric with and 35, 0 feet from the centerline of said abandoned Highway, a distance of 86.3 feet to end of curve at right angles from Engineer's P. T. Station 55649.2 on the center- line of said abandoned Highway; THENCE SOUTH 56°02' West, parallel to and 35.0 feet from the center- lihe of abandoned F. M.
