HATCH FOR THE CONVEYANCE OF RIGHT-OF-WAY FOR ~, F. M. ROAD 1340 On this the 12th day of November, 196b, came on to be heard and considered by the I~ Court the letter offer dated October 28, 1968, of Mary B. Hatch, the surviving widow of ~ W. N. Hatch, Deceased, and Independent Executor of the Estate of W. N. Hatch, Deceased, to convey to the State of Texas 2y.49 acres of land out oŁ Surveys No. 6, Abstract No. 15811 and out of Survey No. 4, Abstract No. 1579 and to grant to the State of Texas a Channel Easement comprising 1.056 acres out of said Survey No. 4, the foregoing being for the purpose of providing right-of-way for the extension of F. M. Road 1340; And it appearing to the Court that her offer ie reasonable and in the best interests of all concerned, it is ordered on motion by Commissioner Stone, seconded by Commissioner Bartel and unanimously approved by the Court that Kerr County hereby accepts the aforesaid offer and will pay the said Mary B. Hatch in her individual capacity and as Independent Executor oY the Estate of W. N. Hatch, Deceased, the sum oY 37,550.00 for land, damages, and severance damages ae compensation for her conveyance to the State oP Texas oŁ the right- of-way and the granting oŁ the channel easement as aforesaid; And it is further ordered that in addition to the foregoing cash consideration, Kerr County will provide the following at no cost to the landowner: 1. Construct a new livestock fence on both aides of the right-of-way conveyed consisting of 39 inch net wire topped with one smooth cable wire and heart cedar poets set 30 feet apart with 3 heart cedar stays between. 2. Six 12 foot steel gates will be provided at locations acceptable to the landowner and the Texas Highway Department. 3. Three cattle guards as described in the aforesaid letter offer will be provided. 4. Kerr County in co-operation with the Texas Highway Department will provide for the use of two drainage et ructu res as stockpasses, the north at ructure to be 7 feet in height and 10 feet in width and the south structure to be seven feet in height and 8 feet in width, all by interior measement, and fencing will be winged to each after completion oŁ construction. 5.
