N0. 10701 ORDER FIXING SALARY AND ALLOWANCES OF COUNTY ATTORNEY
On this the 13th day of May 1968, upon motion made by Commissioner Stone, seconded
by Commissioner Schwethelm, the Court unanimously approved that the County Attorney's
salary be set at $7200.00 per annum, plus allowance of $600.00 for rent and $600.00 allow-
ance for secretarial service, said allowances to be paid as he may direct.

N0. 10702 ORDER ACCEPTING OFFER OF NA`T'IONAL BANK OF COP'~'IERCE OF SAN ANTONIO, TRUSTEE, TO
DONA`1'E RIGHT-OF-WAY FOR F. M. ROAD 1340
On this the 13th day of May, 1968, came on to be heard and considered by the Court the
offer of National Bank of Commerce of San Antonio, 'Trustee, to donate right-of-way through
a portion of the Stowers Ranch for the extension of F. M. Road 1340 in consideration for the
construction by Kerr County of a deerproof fence along the line of the right-of-way to be
donated;
And it appearing to the Court that the value of the right-of-way and channel easement
concerned equals the estimated difference in cost between a standard livestock fence and a
deerproof fence along the line of the right-of-way concerned;
It is ordered on motion by Commissioner Stone, seconded by Commissioner Schwethelm, and
unanimously approved by the Court that Kerr County hereby accepts the offer of the National
Bank of Commerce of San Antonio, Trustee, to donate to the State of Texas ------ 14.824
acres of right-of-way out of Surveys 716 and 1438, together with the granting of one Channel
Easement comprising 0.184 acreaof land out of Sruvey 1439; and in consideration for the
donation of the right-of-way and channel easement concerned, Kerr County will construct
5,767 feet of deerproof fencing along the south side of the right-of-way conveyed, doing so
to the same specifications as were employed in the construction of fencing erected previous-
ly on the adjacent section of F. M. Road 1340 constructed through a portion of the Stowers
Ranch, and the said new fencing shall include one 12 foot steel gate.

On this the 13th day of May 1968, upon motion made by Commissioner Schwethelm, seconded
by Commissioner Bartel, the Court unanimously approved that the provisions of Order No.
10354 be extended to partial payments for present F. M. 1340 fencing.

PENDING IN DISTRICT COURT
On this the 13th day of May 1968, came on to be heard and considered by the Court
the necessity of authorizing and directing County Attorney Edgar A. Wallace to act on
behalf of Kerr County and the State of Texas in the matter of intervening and filing
eleven claims in the District Court of Kerr County pursuant to Article 7345b, Texas Civil
Statutes, the said Causes being delinquent tax suits, listed as follows:

It appearing to the Court that the Kerr County Tax Collector has been heretofore
served with citation in said causes on behalf of Kerr County and the State of Texas and
that intervention and filing of claims in these causes are required to preserve the claims
of Kerr County and the State of Texas arising from delinquent taxes due them and constitut-
ing a lien on the property which is subject to the said delinquent tax suite, it is ordered
on motion by Commissioner Stone, seconded by Commissioner Burney and unanimously approved
by the Court that the County Attorney Edgar A. Wallace, be authorized and directed to
proceed to file an intervention in the said causes as above set forth and otherwise proceed
according to law in this matter.

Treasurer be, and are hereby directed to apportion the sum of $12,000.00 out of the General
Road and Bridge Fund to the respective Commissioners' precincts:
