A. Kerr County will construct a new fence, furnishing all materials therefor, along V the west line of the easement granted, the posts to have tops with a minimum diameter of 4 inches, and with other specifications to be the same as those of the fence reoently constructed immediately to the north and along the east line of the Chester Schwethelm property, with gates to be recessed to the owners satisfaction. B. Anew fence will be constructed by Kerr County on the west side of the Stoneleigh Road between the railroad and Highway 27, using materials furnished by the owner. C. All wire and other salvagable materials will be rolled up and otherwise preserved for the retention of the owner. D. Kerr County will move all excess dirt on the easement granted and on a strip of land at least 15 feet to the west side of the new fence line, the excess dirt so moved to be properly spread on the adjacent field to the west of the road or to be filled in other adjacent low places as requested by the owner. E. Kerr County will provide and install two 16 foot and two 14 foot steel gates in the new fencing at sites designated by the owner. "~ F. Kerr County, by accepting the aforesaid written easement, hereby grants the said Robert Lee Mosty the right to maintain two irrigation lines across the entire width of the Stoneleigh Road and agrees to install the necessary conduits and/or pipes to be furnished by the owner for this purpose. One of the said lines to be located 5 feet north of the railroad right-of-way and the other approximately 370 feet south of the north line of that tract on the east side of the Stoneleigh Road as heretofore conveyed by La Merle Bender Butler, et al, to Robert Lee Mosty and Robert Lee Mosty, Jr. G. In addition to the foregoing consideration, Kerr County will pay the said Robert Lee Mosty the sum of $500.00 as partial compensation for land and damages. And it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the General Road and Bridge Fund in the amount of $500.00 payable to Robert Lee Mosty, the said voucher to be delivered on receipt of his properly executed Right-of- Way Easement as aforesaid, and the said Robert Lee Mosty shall be furnished with a certi- fied copy of this order. o-o-o-o-o-o-o-o-o-o NU. 10870 EXTENSION OF ALLOWANCE OF STONEY ARMSTRONG FOR SIX MONTHS EFFECTIVE FEBRUARY 1, 1969 On this the 10th day of February 1969, upon motion made by Commissioner Stone, second- ed by Commissioner Schwethelm, the Court unanimously approved that the monthly allowance of Stoney Armstrong be extended for six months, effective as of February 1, 1969. o-o-o-o-o-o-o-o-o-o N0. 10871 ORDER CREATING KERRVILLE-KERB COUNTY JOINT MUNICIPAL AIRPORT ZONING BOARD Un this the 10th day of February, 1969, at the regular meeting of the Commissioners' Court of Kerr County, Texas, with a quorum present, came on to be considered by the Commissioners' Court of Kerr County, Texas, at a regular term of such Court, the matter of the creation of a joint airport zoning board to exercise the powers authorized such boards by the provisions of the Airport Zoning Act (Articles 46e-1 to 46e-15, inclusive, V.A.C.S.) and Acts amendatory thereof or supplementary thereto, to adopt, administer and enforce airport zoning regulations applicable to airport hazard areas in this County; and it appearing to the Court that on the 6th day of February, 1969, the City Council of the City of Kerrville, Texas, did enact its ordinance creating such a joint airport zoning ~~ board, to be known as the Kerrville-Kerr County Joint Municipal Airport Zoning Board, and which ordinance was expressly made subject, for its effectiveness, to a like provision being made by the Commissioners' Court of Kerr County, Texas, and it further appearing to the Court that the creation of such a joint airport zoning board is in the public interest of this County; IT IS ACCORDINGLY ORDERED, AND there is hereby created the Kerrville-Kerr County Joint Municipal Airport Zoning Board which Board shall have the powers and exercise the duties set forth in the Airport Zoning Act (Articles 46e-1 to 46e-15, inclusive, V.A.C.S.) and Acts amendatory thereof or supplementary thereto). IT 1S FURTHER ORDERED that the Kerrville-Kerr County Joint Municipal Airport Zoning Board shall be composed of five (5) members, two (2) to be appointed by the City Council of the City of Kerrville, Texas, and two (2) members to be appointed by this Commissioners' Court. The fifth member shall be elected by a majority of the members so appointed and said fifth member shall serve as Chairman of the said Kerrville-Kerr County Joint Municipal Airport Zoning Board. IT IS FURTHER ORDERED that Col. John P. Wells and W. H. Cowden are hereby appointed as the County's members on said Kerrville-Kerr County Joint Municipal Airport Zoning Board. o-o-o-o-o-o-o-o-o-o N0. 10872 ORDER ACCEPTING PROPOSAL OF WHELAN AND VAN CONSTRUCTION COMPANY FOR EMERGENCY REPAIR TO THE INGRAM DAM On this the 10th day of February, 1969 came on to be heard and considered by the Court the matter of emergency repairs necessary to preserve the Ingram Dam previously constructed by Kerr County, and it appearing to the Court that the risk of spring floods causing permanent damage to or possible loss of the south end of the Ingram Dam as a result of erosion of the abutting enbankment creates an emergency, and it further appearing to the Court that the proposal as submitted this date by the Whelan and Van Construction Company of Ingram, Texas is based on sound engineering study and is designed to furnish permanent protection against a washout of the south end of the said dam, it is ordered on motion by Commissioner Stone, seconded by Commissioner Burney and unanimously approved by the Court that Kerr County hereby accepts the proposal of the said Whelan and Van Construc- tion Company to make the necessary emergency repairs as per plans and specifications filed this date at a cost of $3,634.00 to be paid out of current funds upon satisfactory comple- tion of the said emergency repairs. o-o-o-o-o-o-o-o-o-o N0. 10873 TRANSFER OF $5000.00 FROM F. M. Lateral Road Fund to the F.
