Upon motion made by Commissioner Bartel, seconded by Commissioner Burney, the Court unanimously approved that the bid of Holt Machinery Company for one new Caterpillar D5 Tractor be accepted as the lowest and best bid, according to specifications and that the alternate proposal of trade-in of one used D6 Crawler Tractor be accepted. Burney Commissioner Precinct 2 Adolph Bartel Commissioner Precinct 3 Roger Stone Commissioner Precinct 4 and the Court having duly opened, the following proceedings were had: N0. 10948 ORDER GRANTING COivSEN'1' TO LEASE ASSIGNMENT' AND APPROVAL OF HYPOTHECA'1ION BY MOCNEY AIRCRAF'T' CORPORATION AS '10 LEASEHOLD INTERESTS AT LOUIS SCHREINER FIELD On this the 1st day of July 1969, came on to be heard and considered by tYe Court the request of Mooney Aircraft Corporation, Successors to Mooney Aircraft, Inc. and Mooney Corporation that Kerr County join with the City of Kerrville as Lessors in granting consent to certain previous assignments of the leasehold rights of the former Corporations known as Mooney Aircraft Inc. and Mooney Corporation as to certain portions of the City-County Airport property known as Louis Schreiner Field and also the further request for a waiver of certain provisions of Section 9, Paragraph (d) of the original lease agreement as record- ed in Vol L Page 598 of the Minutes of the Commissioners Court, together with the further request for approval of a proposed hypothecation of the leasehold interests now vested in the said Mooney Aircraft Corporation and it appearing to the Court that the aforesaid requests are reasonable and in the best interests of Kerr County and that the City of Kerrville has heretofore granted the aforesaid requests and executed the two submitted instruments, it is ordered on motion by Commissioner Burney, seconded by Commissioner Bartel and unanimously approved by the Court that Kerr County join the City of Kerrville in granting the aforesaid requests as embodied in the two instruments concerned and that the County Judge be authorized to execute the aforesaid instruments in the name of Kerr County and that the same when executed be recorded in the Minutes of the Court. ~~ Mooney Aircraft Corporation Louis Schreiner Field Kerrville, Texas Attention: Mr. Ralph M. We hereby consent to the assignment of all the rights and privileges of the lessee under the captioned lease, Mooney Aircraft, Inc./Mooney Corporation, both Texas corporations, to Mooney Aircraft Corporation, a Pennsylvania corporation, such assignment being effective March 25, 1969• In connection with such assignment, we hereby waive and release any right of forfeiture or termination of the lease which we may have by reason of the bankruptcy of Mooney Aircraft, Inc. and Mooney Corporation or any assignment for the benefit of creditors attempted to be made by such corporations as set forth in Section 9, Paragraph (d), of the referenced lease. This does not waive any rights the lessors have in case of a future bankruptcy of Mooney Aircraft Corporation.
