Order No. 11, 247 Offer to Henry Wellborn and Wife, Helen Wellborn, for Right-of-Way for F. M. Road 480 Šn this the 14th day of December, 1970, came on to be heard and con- sidered by the Court the matter of compensation to be paid Henry Wellborn and wife, Helen Wellborn, as consideration for their conveyance to the State of Texas of two parcels of land required for the reconstruction and widening of F. M. Road 480; and after due consideration, it is ordered on motion by Com- missioner Stone , seconded by Commissioner Burney and unanimously approved by the Court that Kerr County hereby offers to pay Henry Wellborn and wife, Helen Wellborn, the sum of $ 5, OuL'. ~'~ "; for land and damages as consideration for their conveyance to the State of Texas of two parcels of right-of-way comprising 5. 158 acres of land out of Survey No. 46, F. Williams and in addition to the foregoing cash consideration, Kerr County will provide the fallowing: 1. Kerr County will construct approximately 4, 520 feet of new live- stock fencing along the right-of-way line of the two parcels con- veyed, which fencing shall consisi: of 39 inch net wire with one barbed wire on top and pressure treated creosoted posts with 7 inch or better tops Set 25 feet apart with 3 heart cedar stays between; however barbed wire will be substituted for the net wire along the banks of Verde Creek if Kerr County is so re- quested. 2. The existing stockpass situated at Station ?5 of the centerline of the new roadway will be replaced by the State of Texas with an oval metal stockpass 5'8" wide and 6'6" in height, so that the land- owners preexisting rights of stock; passage may be preserved, and Kerr County will, after constructiion of the new roadway, con- struct necessary fencing to provide wings frorri the ends of the stockpass to the right-of-way fencing. 3. The existing 16 foot metal gate situated in the proximity of Station 77 of the centerline of the new roadway will be relocated and in addition, anew I6 foot steel gate will be installed to pro- vide an entrance to the field near the relocated present metal gate. Kerr County will also provide such gate as may be re- quested to provide access to the pasture on the north side of the -2- roadway to be abandoned which was originally included within the easement donated to Kerr County by Henry Wellborn and wife, Helen Wellborn, in the year 1436 and recorded in Vol, 54, Page 526, Kerr County Deed Records. xnay be returned to them and enclosed within their i`enced property boundaries by Kerr County. And it is furthex ordered that the Clerk and the Treasurer be au- thorized to draw a voucher on the F. Ni. 480 ROW Fund in the amount of $ 5, 000. 00 payable to Henry Wellborn and wife, Helen Wellbarn, which voucher shall be delivered upon receipt ~of their properly executed Right-of- Way Deed.
