ROAD 1341 On this the 17th day of April 1y70, came on to be heard and considered by the Court the matter of ar.:endirg Order No. 11111 entered by the Court on the 13th day oŁ April 1970, v and it appearing to the Court that the said Richard Flach and wife, Laura Flach, have agreed to accept a cash consideration of X1,000.00 Łor land and damages resulting from their conveyance to the State of Texas of the parcel of right-of-way concerned. It is ordered on motion by Commissioner Stone, seconded by Commissioner Bartel and unanimously approved by the Court that the said Order No. 11111 be amended so as to increase the cash consideration offered therein to X1,000.00, and It is Further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the F. M. -?c Lateral Road Fund in the amount of X1,000.00, the said voucher to be delivered as set forth in the said Order No. 11111. o-o-o-o-o-o-o-o-o-o N0. 11119 ORDER FOR ELECTION TO CREATE THE KERR COUNTY AIRPORT AUTHORITY THE STATE OF TEXAS ~ COUNTY OF KERR ~ On this the 17th day of April, 1970, the Commissioners Court of Kerr County, Texas, conven- ed in Special Session, due notice of such Special Session having been heretofore posted by the County Clerk of Kerr County For more than three days, with the following members present at the Court's regular meeting place at the Kerr County Courthouse, to-wit: Julius R. DTeunhoffer, County Judge; W. C. Schwethelm, Com. Prec. l; Clinton D. Burney, Com. Prec. 2; Adolph Bartel, Com. Prec. 3; and Roger Stone, Com. Prec. 4, and the follow- ing absent: None, constituting a quorum, and among other proceedings passed the follow- ing order: WHEREAS, there has been filed with this Court a Petition calling upon this Court to order an election to be held within Kerr County to determine whether the Kerr County Airport Authority shall be created and established pursuant to the provisions of Acts of 1967, 60th Legislature, Regular Session, Chapter 393 and of Section 12, Article IX, Constitution of the State of Texas; and, 'WHEREAS, the Court has caused to be made an examination of the said petition and has found to its satisfaction that the said petition bears the signatures of more than five percent of the qualified taxpaying voters residing within Kerr County and who are each owners of taxable property which has been duly rendered for taxation upon the tax rolls of Kerr County, THEREFORE, BE IT ORDERED BY THE COMTIISSIONERS COURT OF KERB COUNTY, TEXAS: THAT an election be held in said County on the 16th day of May, 1970, which date is not less than 30 days nor more than 90 days after receiving the aforesaid petition, at which the following proposition shall be submitted to the qualified taxpaying voters of Kerr County who own taxable property which has been duly rendered for taxation upon the tax rolls of Kerr County for their action thereupon: "Shall there be created the Kerr County Airport Authority as authorized to be established by the provisions of House Bill 965 as enacted and as codified as Chapter 393, Acts of the 60th Legislature of the State of Texas, Regular Session?" THAT said election shall be held under the provisions of the constitution and laws of the State of Texas, including applicable provisions of Chapter 393, Acts of the 60th Legis- lature, Regular Session, and all persons who are currently registered taxpaying voters residing in Kerr County and who own taxable property which has been duly rendered for taxation upon the tax rolls of Kerr County shall be entitled to vote in said election. Collins 19 Fire Substation No. 1 Foster Jones THAT absentee voting shall be conducted at the office of the County Clerk at the Kerr County Courthouse pursuant to applicable provisions of the Texas Election Code between the hours of 8:00 o'clock a.m. and 5:00 o'clock p. m. on each day for absentee voting which is not a Saturday, a Sunday, or an official State Holiday, beginning on the 20th day and continuing through the 4th day preceding the date of said election. F. L. McKinney is hereby designated as Presiding Judge of the Special Canvassing Board for the counting of absentee ballots, pursuant to the provisions of the Texas Election Code. THAT the ballots for said election shall be prepared in accordance with applicable ~~~:~ provisions of the Texas Election Code and shall have printed thereon the following: place an "X" in the square beside the statement indicating the way you wish to vote: D FOR the creation of the Kerr County Airport Authority composed of the area within Kerr County, Texas. Q AGAINST the creation of the Kerr County Airport Authority composed of the area within Kerr County, Texas TIIAT a copy of this order, signed by the County Judge of Kerr County and attested to by the County Clerk of Kerr County, shall serve as proper and sufficient notice of the election herein ordered, and that this order shall be published in a newspaper of general circula- tion throughout the County once a week for two consecutive weeks before the date of election, with the first notice being publiihed no more than 28 nor less than 14 days before the date of election; and in addition, copies hereof shall be posted at the Kerr County Courthouse and filed with the County Clerk oŁ Kerr County. THAT the election judges for each polling place as well as the judge of the Special Canvass- ing Board for absentee voting shall cause the ballots cast herein to be counted and the results certified to the Commissioners Court pursuant to applicable provisions of the Texas Election Code and within 10 days after the date of the election. The above order being read in full, it was moved by Commissioner Schwethelm and seconded by Commissioner Bartel that the same do pass.
