No. 3
Estates/be accepted, provided in so doing Kerr County does not accept as County roadways
the road easements dedicated for public use and further that Kerr County does not assume
responsibility for repairs, maintenance of construction or reconstruction of roadways so
dedicated.

THIS AGREEMENT, made this 1 da,y of June, 1970, by and between Kerr County, Texas,
hereinafter called the "County", Party of the First Part, acting by and through its Commis-
sioners Court and the State of Texas, hereinafter called the "State", Party of the Second
Part, acting by and through its State Highway Commission.
WHEREAS, the County desires the construction of machine laid curb within the limits
from Kerrville City Limits at Golf Street East on Farm to Market Road No. 1341 and the State
will, among other things, provide for the construction of t7ris work within these limits
and the County will contribute a fixed amount of Four Hundred and No/lOC Dollars 0400.00),
in payment for their portion of this work, and
WHEREAS, the County by the execution of this agreement agrees to the terms and condi-
tions of State Highway Commission Minute No. 63631, as it applies to the County, a copy
of which is attached hereto and marked "Exhibit A" and made a part of this agreement.
NOW THEREFORE, it is understood that this proposed work will be constructed by the
State and the County will transmit to the State with the return of this agreement, executed
by the County, a warrant made payable to the State Treasurer, Account of Trust Fund No.
927 in the amount of Four Hundred and No, 100 Dollars 0;400.00). It is further understood

understood that the contribution of Four Hundred and No/100 Dollars 0400.00), by the
County shall be a fixed amount for their share of the work. It is further understood that

County have requested assistance in the construction of a street type section including
incidental items thereto from Golf Avenue, nTortheast a distance of approximately 0.4 mile;

It is understood that the responsibility of the Texas Highway Department is confined
to the pavement and its support, and all other features necessary now or in the fu+ure to
provide an adequate travel £acility shall be the responsibility of the City of Kerrville
and Kerr County.
Upon acceptance of the provisions of this Order by the appropriate officials of the

City of Kerrville and Kerr County, the State Highway Engineer is directed to proceed with
the development of plans for construction and after the City and County have fulfilled
their responsibilities, proceed with construction in the most feasible and economical
manner, financing the work as a portion c£ the project presently authorized in the 1970
Farm to Market Road Improvement Program.

It is understood that the City and/or County may discharge their construction obliga-
tions as outlined herein in any manner as they riay elect. In the event the City and/or
County desires the State to include their portion of the work in the State's construction
contract, the State Highway Engineer is hereby authorized to enter into agreement with
the City and/or County for such work and its cost as may be agreed upon.
This Order shall become operative upon acceptance by ħhe City of Kerrville and Kerr
County and if not accepted within 90 days of the date hereof, the action herein contained
shall be automatically cancelled.

were made a part hereof and of this order.

On this the 8th day of June 1970, came on to be examined by the Court the various
reports of May of the County and Precinct Officers of Kerr County, Texas, and the same
having been heard and considered by the Court, finds that said reports are true and correct
and should be approved; therefore, upon motion of Commissioner Stone, seconded by Commis-
sioner Schwethelm, the Court unanimously approved that the submitted reports be accepted
and filed with the County Clerk for future reference and subject to audit.
