M. ROAD 48C On this the 14th day of December, 1970, came on to be heard and considered by the Court the matter of compensation to be paid Henry Wellborn and wife, Helen Wellborn, as consideration for their conveyance to the State of Texas of two parcels of land required for the reconstruction and widening of F. M. Road 480; and after due consideration, it is ordered on motion by Commissioner Stone, seconded by Commissioner Burney and unanimously approved by the Court that Kerr County hereby offers to pay Henry Wellborn and wife, Helen Wellborn, the sum of ;65,000.00 for land and damages as consideration for their conveynce to the State of Texas of two parcels of right-of-way comprising 5.158 acres of land out of Survey No. 46, E. Williams; and in addition to the foregoing cash consideration, Kerr County will provide the following: 1. Kerr County will construct approximately 4,520 feet of new livestock fencing along the right-of-way line of the two parcels conveyed, which fencing shall consist of 39 inch net wire with one barbed wire on top and pressure treated creosoted posts with 7 inch or better tops set 25 feet apart with 3 heart cedar stays between; however barbed wire will be sub- stituted for the net wire along the banks of Verde Creek if Kerr County is so requested. 2. The existing stockpass situated at Station 75 of the centerline of the new roadway will be replaced by the State of Texas ~~~ith an oval metal stockpass 5'8" wide and 6'6" in c~~ height so that the landowners preexisting rights of stock passage may be preserved, and Kerr County will, after construction of the new roadway, construct necessary fencing to provide wings from the ends of the stockpass to the right-of-way fencing. 3. The existing 16 foot metal gate situated in the proximity= of Station 77 of the center- line of the new roadway will be relocated and in addition, a new 16 foot steel gate will be installed to provide an entrance to the field near the relocated present metal gate. Kerr County will also provide such gate as may be requested to provide access to the pasture on the north side of the new roadway, as well as provide a 6v'2 foot cattle guard with metal wings and a 10 foot gate for the residence entrance roadway. 4. As further consideration for the granting of the right-of-way conveyed, Kerr County will, after construction of the new roadway, request the Texas Highway Department for permission to close and abandon that portion of the existing route of F. M. Road 480 lying to the north of the new roadway in the proximity of Stations 85 through 93 of the new roadway so that that portion of the old roadway to be abandoned which was originally includ- -2 ed within the easement donated to Kerr County by Henry Wellborn and wife, Helen Wellborn, in the year 1936 and recorded in Vol. 59, Page 526, Kerr County Deed Records, may be return- ed to them and enclosed within their fenced property boundaries by Kerr County. And it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the F.
