R E S O L U T I O N
WHEREAS, the City of Kerrville and the County of Kerr are the
joint owners of the Municipal Airport; and
WHEREAS, the citizens of Kerr County have presented a petition
to the Kerr County Commissioners Court to call an election for the
creation of the Kerr County Airport Authority under the provisions of
House Bill No. 956 of the 60th Legislature, entitled "An Act Relating
to Creation of the Kerr County Airport Authority Under Section 12,
Article IX, Constitution of the State of Texas; Providing For the
Authority's Establishment, Organization, Administration, and Financing;
and
WHEREAS, Section 5, sub-section (b) of said Act provides that
prior to calling the election, the governing body of the City of
Kerrville shall determine by majority vote whether the directors of said
Airport Authority are to be appointed or elected;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KERRVILLE, TEXAS that members for the Board of Directors of the
proposed Kerr County Airport Authority shall be appointed by the Com-
missioners Court of Kerr County as provided in Section 6 of said Act.
PASSED, ADOPTED AND APPROVED by majority vote this 14th day of
April, 1970.

On this the 17th day of April, 1970, the Commissioners Court of Kerr County, Texas,
convened in Special Session, due notice of such Special Session having been $ereto-
fote posted by the County Clerk of Kerr County for more than three days, with the fol-
lowing members present at the Court's regular meeting place at the Kerr County
Courthouse, to-wit:
Tuliua R. Neunhoffer, County Judge; W. C. Schwethelm, Com. Prec. 1; Clinton L`.
Burney, Com. Prec. 2; Adolph Bartel, Com. Prec. 3; and Roger Stone, Com. Prec.
4, and the following absent: None
constituting a quorum, and among other proceedings passed
order:
WHEREAS, there has been filed with this Court a Petition calling upon this Court to
order an election to be held within Kerr County to determine whether the Kerr County
Airport Authority shall be created and established pursuant to fhe pro~~isiona of Acts
of 1967, 60th Legislature, Regular Seaaion, Chapter 393 sad of Section 12, Article IX,
Constitution oŁ the State of Texas; and,
~'VHEREAS, the Court has caused to be made an examination of the said petition and has
found to its satisfaction that the said petition bears the aignaturea of more than five
percent of the qualified taxpaying voters residing within Kerr County and who are each
owners of taxable property which has been duly rendered for taxation upon the tax
rolls of Kerr County,
THEREFORE, BE IT ORDERED BY THE COMMISSiONER5 COURT OF KERR COUNTY,
TEXAS:
THAT as election be held in said County an the I6th day of May. 1970. which date is
not less than 30 days nor more than 90 days after receiving the aforesaid petition. at
which the following proposition shall be submitted to tlae qualified taxpaying voters of
Kerr County who own taxable property which has bean duly rendered for taxation upon
the tax rolls of Kerr County for their action thereupon:
"Shall there be created the Kerr County Airport Authority as authorized to be eatab-
lished by the provisions of Hauae Bill 965 as enacted and as codified as Chapter 393,
Acts of the 60th i.egisiature of the State of Texas, Regular Seasion7"
THAT said election shall be held under the provisions of the constitution and laws of
the State of Texas, including applicable proviaioaa of Chapter 393, Acta of the 60th
Legislature, Regular Session, and all persons who are eurrently registered taxpay-
ing voters residing in Kerr County and who own taxable property which has bees duly
rendered for taxation upon the tax rolls of Kerr County shall be entitled to vote in
said electiaa.
THAT the polling places for said election shall open at 8:00 a. m, on the 16th day of
May, 1970, and shall close at 7:00 o'cloek p, m, on the 16th day of Maq, 1970, sad

T134AT the ballots for said election shall be prepared in accordance with applicable
ptiavlsions of the Texas Election Code and shall have grimed thereon the following:

AGAINST the creation of the Kerr County Airport Authority composed
of the area within Kerr County, Texas.
THAT a copy of this order, signed by the Gouaty Judge of Kerr County and attested
to by the County Clerk of Kerr County, shall serve as proper sad sufficient aoHce
of the election heron ordered, sad that this order shall be published in a newspaper
of general circulation throughout the County once a week for two consecutive weeks
before the date of eltction, with the first aatice being published no more than 28 nor
Leas than 14 days befare the daft of eltction; sad in addstioa, copies hereof shall be
posted at the Kerr County Caurthouse seal filed with the County Clerk of Kerr County.
THAT the election judges for each polling place as well as the judge of the Special
Canvassing Board for absentee voting shall cause the ballots cast herein to bt count-
ed and the results certified to the Commissioners Court pursuant to applicable pro-
visions of the Texas Election Code and within 10 days after the daft of the eltction.

sad seconded by Commissioner Bartel that the same do gees. There-
