Order No. 11, 293 Offer to Ida Limberger Kneese for Right-of-Way for F. M. Road 480 On this the 8th day of February, 1971, came on to be heard and con- sidered by the Court the matter of compensation to be offered Ida Limberger Kneese for. her conveyance to the State of Texas of three ,parcels of land re- quired for right-of-way, together with the granting of two channel easements required for the reconstruction and wideriing of F, M. Road 480; and after due consideration, it is ordered on motion by Commissioner Bartel seconded by Commissioner Stone and unanimously approved by the Court that Kerr County hereby offf~rs to pay the said Ida Limberger Kneese the sum of $5, 400. 00 for land and damages for her convey- ance to the State of Texas of the aforesaid three parcels of right-of-way com- prising 10. 515 acres out of Surveys 104, and 102, together with her granting two channel easements comprising 0. 308 acres out of Surveys 104 and 102; and in addition, Kerr County will provide the following: 1. Kerr County will construct approximately 6, 500 feet of new livestock fencing along the right-of-way lines of the parcels con- veyed, which fencing shall consist of 39 inch net wire with one barbed wire on top and pressure treated posts with 7 inch or better tops set 25 feet apart with 3 heart cedar stays between. 2. Kerr County will install a total of three 14 foot steel gates, one to replace the present gate across the rid from the mail box and the other two for access to the field east of the Witt property and to the strip of land left between the new roadway and the present route of F. M. 480. 3. The existing stockpass situated west of Station 156 of the center- -2- veyed, Kerr County will, after the construction of the new roadway, request the Texas Highway Department for permission to close and abandon that portion of the existing route of F. M. Road 480 lying to the north of the strip of land severed from the eastern portion of the field lying between the Lapham and Witt properties so that the ap- proximately 1, 3 acres of the old roadway to be abandoned, which was included as a portion of the lands originally donated by the late C. F. Limberger for the construction of the old roadway may be returned to her and enclosed within her fenced property bounda- ries by Kerr County. Should the State of Texas fail or refuse to render such abandonment and reconveyance possible, Kerr County will then pay the said Ida Limberger Kneese an additional sum of $500. 00 cash consideration to serve as severance damages for the land cut off from her field by the new roadway. And it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the F. M. ROW Fund in the amount of $ 5, 400.00 payable to Ida Limberger Kneese, which voucher shall be delivered upon re- ceipt of he.r properly executed Right-of-Way Deed and Channel Easements.
