Order No. --~ Amended Offer to Ida Limberger Kneese for Right-of- Way for F. M. Road 480 On this the I3th day of September, 1971, came on to be heard and con- sidered by the Court the offer of compromise and settlement relative to the compensation to be offered Ida Limberger ]~neese for her conveyance to the State of Texas of three ,parcels of land required for right-of-way, together with the granting of two channel easements required for the reconstruction and widening of F. M. Road 480; and aftex due consideration, it is ordered ~. on motion by Commissioner ..~` seconded by Commissioner and unanimously approved by the Court that Kerr County hereby offers to pay the said Ida Limberger Kneese the sum of $7, 500. 00 for land and damages for her conveyance t~o the State of Texas of the afore- said three parcels of right-of-way comprising 10. 515 acres out of Surveys 104 and 102, together with her granting two channel easements comprising 0. 308 acres out of Surveys 104 and 102; arLd in addition, Kerr County will provide the following: 1, Kerr County will construct approximately b, 500 feet of new livestock fencing along the right-of-way lines of the .parcels conveyed, which fencing shall consist of 39 inch net wire with one barbed wire on top and. ,pressure treated .posts with 6 inch or better tops set 25 feel; apart with 3 heart cedar stays between, 2, Kerr County will install a total of three 14 foot steel gates, one to replace the ,present gate across the road from the mail box and the other two for access to the field east of the Witt property and to the strip of land left between the new roadway -2- 4, As further consideration for the granting of the right-of-way con- veyed, Kerr County will, after the construction of the new road- way, request the Texas Highway Department for permission to close and abandon that portion of the existing route of F. M, 480 lying to the north of the strip of land severed from the eastern portion of the field lying between the Lapham and Witt propertie s so that the approximately 1, 3 acres of the old roadway to be aban- doned, which was included as a portion of the lands originally do- - nated by the late C. F. Limberger for the construction of the old roadway, may be returned to her by ,:Zuitclaim Deed and enclosed within her fenced property boundaries by Kerr County. And it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the F. M. ROW Fund in the amount of $7, 500. 00 payable to Ida Limberger Kneese, which voucher shall be delivered upon receipt of her properly executed Right-of-Way Deed and Channel Easements.
