r/3/~i Offer to Mildred Shields Smith and Tyson Smith, Individually and as Co-Trustees under the Will of Nowery J. Smith, De- ceased, for Right-of-Way for F. M, Road 480 On this the day of 1971, came on to be heard and considered by the Court the matter of compensation to be offered Mildred Shields Smith and Tyson Smith, Individually and as Co-Trustees under the Will of Nowery J. Smith, Deceased, for their conveyance to the State of Texas of two parcels of land required for right-of-way, together with their granting of one channel easement required for reconstruction and widening of F. M. Road 480, and after due considera- tion, it is ordered on motion by Commissioner Commissioner seconded by and unanimously approved by the Court that Kerr County hereby offers to pay the said Mildred Shields Smith and Tyson Smith, individually and as Co-Trustees in the manner hereinafter set forth the sum of and severance damages $9, 447. 50 for land and damages/for their conveyance to the State of Texas of the aforesaid two parcels of right-of-way comprising 7. 895 acres of land out of Survey 102 and 103, together with their granting of one channel easement comprising 0. 069 acres out of Survey 103; and in addition, Kerr County will provide the following: 1. Kerr County will construct approximately 3, 178 feet of new deerproof fence along the south side of the right-of-way conveyed, which fence will be to the same standards as that on the present south right-of-way line of F. M. Road 480. The existing gate on the Klein Branch Road will be relocated on the new right-of-way line. The present stone entrance, together with the existing gates and cattle guard will be re- constructed and relocated with appropriate setback from the new right- of-way line. The existing sign at the entrance will also be relocated as desired. Kerr County shall have i;he option to reuse any suitable materials salvaged from the present structures. Kerr County will also provide the necessary concrete base for an extension of approxi- -2- lie within the right-of-way conveyed. Two 12 foot steel gates will be provided in locations acceptable to they landowners and the Texas High- way Department, 3. Kerr County will provide, by agreement with the Texas Highway De- partment, an oval metal stockpass 6'6't high and 5'8" wide to serve as a combined drainage structure and stockpass in the ,proximity of Station 246 of the centerline of the new roadvray and will, after construction, provide fencing wings from the right-of-way line to the structure, 4. All existing pipes under F. M, Road -480 will be relocated and cased according to requirements of the Texas Highway Department. 5. In addition to the foregoing cash consideration, Kerr County will, after the construction of the new roadway, seek to have the State of Texas close and abandon the existing route ~~f F. M. 480 from the proximity '~ of Station 236 of the centerline of the new roadway westward to the northeast corner of the former Roland Walters tract of land as con- ` veyed to Rex Kelso, so that it may bE> reconveyed to the original owners and/or their successors in title. And it is further ordered that the Clerk and the Treasurer be authorized to draw the following vouchers on the F. M. 480 Right-of-Way Fund, which vouchers shall be delivered upon receipt of the properly executed Right-of-Way Deed and Channel Easement. 1, Voucher in the amount of $4, 412. 75 ;payable to Mildred Shields Smith and Tyson Smith, Co-Trustees under the Last Wi11 of Nowery J. Smith, Deceased. 2. Voucher in the amount of $4, 412.75 payable to Mildred Shields Smith, 3. Voucher in the amount of $622. 00 payable to Tyson Smith.
