the existing contract and the working arrangements agreed upon thereunder are providing
satisfactory rural fire protection for the citizens of Kerr County and that it would be to
the best interest of Kerr County to renew such contract for a one year period,
It is, therefore, ordered on motion by Commissioner Schwethelm, seconded by Commis-
sioner Stone and unanimously approved by the Court that the existing Fire Contract with
the City of Kerrville, Texas, as amended effective June 1, 1970, be renewed for a period
of one year r,ornmenr,ing June 1, 1971 and ending May 31, 1972 as provided in Part C of the
existing contract, said renewal to become effective upon the joinder therein by the City
of Kerrville by letter acr,eptance as provided for by the terms of Part C, and it is further
ordered that the Clerk of this Court forward a certified copy of this order to the City of
Kerrville, Texas.

On this the 10th day of May, 1971, came on to be heard and considered by the Court
the matter of requesting the Texas Highway Department to reconvey to Josephine Reid Flutter
and husband, C. N. Nutter, a strip of unused right-of-way on the south side of State High-
way 27 east of Mountain Home; and it appearing to the Court that the said Josephine Reid
Nutter and husband, C. N. Nutter, did donate to the State of Texas for right-of-way
purposes a	parcel of land	comprising	3.36 acres	out	of	Survey	1102	in the name	of	C. P.
Smith, as	is evidenced by	deed dated	August 3,	1947	as	is of	record	in Volume	82,	Page 444
of the Kerr County Deed Records; and it further appearing to the Court that a portion of
the said 3.36 acres of land donated, comprising a strip approxir:iately fifty feet wide and
three hundred feet long, has never actually been incorporated into the right-of-way of
State Highway 27 and that such strip of land has no foreseeable use for right-of-way
purposes,
It is ordered on motion by Commissioner Stone, seconded by Cormissioner Bartel and
1 unanimously approved by the Court that Kerr County hereby requests the Texas Highway
N Department to cause such surplus strip of land to be reconveyed by the State of Texas to
the original donors for the reasons herein set forth.
