On this the 13th day of September, 1y71, came on to be heard and considered by the
Court tl:e matter of compensation to be offered P~Iildred Shields Smith end Tyson Smith,
Individually and as Co-Trustees under the 'dill of Mowery J. Smith, Deceased, for their
conveyance to the State of Texas of two parcels of land re~iuired for right-of-way, together
with their granting of one r•hannel easement re,;uired for reconstruction and widening of
F. PT. Road 480, and after due consideration, it is ordered on motion by Commissioner Bartel,
seconded by Commissioner Sallee, ~znd unanimously approved by the Court tk.at Kerr County
hereby offers to pay the said Mildred Shields Smith and Tyson Smith, individually and as
Co-Trustees in the r.:anner hereinafter set forth the sum of $9,447.50 for land and damages
and severance damages for their conveyance to the State of Texas of the aforesaid two
parcels of right-of-wa,y comprising 7.895 acres of land out of Survey 102 and 1G3, together
with t'r.eir granting of one channel easement comprising 0.063 acres out of Survey 103; and
in addition, Kerr County will provide the following:
~. Kerr County will construct approximately 3,17£3 feet of new deerproof fence along the
south side of the right-of-way conveyed, which fence will be to the same standards as that
on the present south right-of-way line of F. M. Road 490. The existing gate on the Klein
Branch Road will be relocated on the new right-of-way line. The present stone entrance,
together vri.th the existing gates and eattleguard will be reeonstruc.ted and relocated with
appropriate setback from the new right-of-way lire. The existing sign at the entrance will
also be relocated as desired. P.err County shall 'nave the option to reuse any suitable
materials salvaged from the present structures. Kerr .County will also provide the necessary
nonerete base for an extension of approximately 10 feet for the relocated entrance cattle-
guard .
2. Kerr County will construct approximately 1,458 feet of deerproof fence on the north
side of the right-of-way conveyed in the area where it departs from the existing route of
F. M. 480. whirr. fence shall be construr.ted to the game standards of the existing fence.
Kerr County shall have the option of salvaging and reusing for this section of fence any
and all. materials found in that portion of the existing fences which lie within the right-
of-way nonveyed. Two 1? foot steel gates will. be provided in l.oc.ations aec,eptable to the
landowners and the Texas Highway Department.
3. Kerr County will provide, by agreement with the Texas Highway Department, an oval
metal stockpass 6'b" high and 5'8" wide to serve ors a combined drainage structure and stock-
pass in the proximity of Station 246 of the nenterline of the new roadway and will, after
construction, provide fencing wings from the right-cf-way line to the structure.
4. All existing pipes under F. Ni. Road 480 will be relocated and cased according to
re~~uirements of the Texas Highway Department.
5. In addition to the foregoing Dash consideration, Kerr County will, after the construc-
tion of the new roadway, seek to have the State of Texas close and abandon the existing
route of F. M. 480 from, the proximity of Station 23n of the centerline of the new roadway
westward to the northeast comer of the former Roland Walters tract of land as nonveyed to
Rex Kelso, so that it may be renonveyed to the original owners andr`or their suncessvrs in
title.
And it is further ordered that the Cleric rznd the Treasurer be authorized to draw the
following vouorere on the F. Pi. ~ti„0 Rigla-of-',Ja;,r Furd, which voun'r.ers shall be delivered

upon receipt of the properly executed Right-of-Way Deed and Channel Easement.

two additional gates on that cord on of trio Klein Branch Road which crosses their property,
provided that such gates shall. be at least 1:Y feet in .aidt'r: and without overhead obstruc-
tions and shall be cap:zble oi' being readily opened and dosed by t'rtose persons using the
said Klein Brancr. Road.
